Summary / Abstract:

LTNė viena Lietuvos teisės mokslo sritis šiandien taip nestokoja teisės literatūros ir mokslinio įdirbio kaip teisės teorija. Praktiškai iki šiol Lietuvos jurisprudencijoje ir pozityviojoje teisėje vyravo etatistinė teisės samprata, teise laikiusi bet kokį valdžios imperatyvą, paverstą privalomo elgesio taisykle. Pasikeitus vertybių sistemai ir atsiradus kitokios teisės sampratos poreikiui, pirmiausia tenka kildinti teisę ne tiek iš valstybės valios, kiek iš visuomenės vertybių, kurios būtų privalomos ir įstatymų leidėjui. Todėl teisės teorijoje, autoriaus teigimu, dera ne tik išdėstyti šiuolaikinę teisės sampratą, bet ir jos pagrindu iš naujo įvertinti ligšiolinę šios srities patirtį, atskirti tai, kas gyvastinga, nuo to, kas atgyvenę, įveikti tą jurisprudencijos klodą, kuris buvo tiesiogiai susijęs su totalitariniu režimu ir efemeriška jo teisės samprata. Knygoje nesistengiama vengti problemiškų dalykų, manant, kad sąlytis su problemomis suteikia galimybę studijuoti gyvą teisės mokslą. Orientuojamasi ne vien į pirmo kurso studento teisininko kvalifikacijos poreikius, bet ir į aukštesnių kursų studentiją ir apskritai teisininkus, kurie teisės teorijoje galbūt ieško paramos spręsdami šakinių teisės mokslų problemas. Knygoje autorius siekia pateikti ir savo požiūrį, pirmiausiai grįsdamas visą teisės teorijos kursą dviem pagrindinėmis idėjomis: teisės kaip proceso (trijų teisinės būties lygmenų) ir teisės kaip subjektinių teisių ir pareigų vienovės. ENAt present, none of Lithuanian law sciences experiences such a need for legal literature and academic contribution as the legal theory does. So far, the etatistic interpretation of law has practically prevailed in Lithuanian jurisprudence and positive law. It interpreted law as any imperative transformed into a rule of compulsory behaviour. With the system of virtues having changed and the need for a new interpretation of law having emerged, the law should be originated not so much from the will of the state, but from social virtues, which should also apply to the legislator. Therefore, the author claims that the theory of law should not only provide the contemporary concept of law, but to use it as a basis to reassess the previous experience of this field, to define what is still relevant and what has lost its relevance, to overcome the layer of jurisprudence, which was directly related to the totalitarian regime and its ephemeral interpretation of law. The book does not avoid problematic issues. The author believes that facing these problems provides opportunity to study the living science of law. The book is intended not only for professional needs of a first year law student, but also for other students of law and lawyers in general, who are probably looking for support in the theory of law when dealing with problems in various branches of the science of law. The author of the book also seeks to presents his opinion, by first of all, grounding the whole course of the theory of law with the key ideas of law, i.e. law as a process and law as the unity of entitlements and obligations.
