Summary / Abstract:

LTNuo Baudžiamojo proceso kodekso (BPK) įsigaliojimo pastebimai ima keistis Lietuvos baudžiamojo proceso teisės šaltinių struktūra – vis didesnę praktinę reikšmę įgyja generalinio prokuroro priimami norminiai teisės aktai, pavadinti rekomendacijomis, nurodymais, įsakymais, netgi aiškinamaisiais raštais. Teisinėje valstybėje baudžiamieji procesiniai santykiai iš principo turėtų būti reglamentuoti baudžiamojo proceso įstatyme – kodekse, o ne generalinio prokuroro rekomendacijomis. Generalinio prokuroro rekomendacijos tiek formos, tiek turinio požiūriu daugeliu atvejų neatitinka konstitucinio legalumo kriterijų, todėl taikant šiuos norminius aktus reikia įdėmiai įvertinti, ar ir kiek atskiroje rekomendacijoje apibrėžtas teisinis reguliavimas yra legitimus Konstitucijos ir BPK atžvilgiu. Lietuvos Respublikos įstatymai neužtikrina realaus ir veiksmingo teisinio mechanizmo, garantuojančio kvalifikuotą generalinio prokuroro rekomendacijų legalumo kontrolę. ENAfter coming into force of Criminal procedure code the structure of Lithuanian legal issues of criminal procedure was changed – more important for procedural practice become legal acts issued by Prosecutor General, that are called as recommendations, orders, even explanatory letters. Unfortunately often these recommendations regulate procedures that must be regulated by criminal procedure laws. Some recommendations are issued without assignment from legislation; legality of some norms in recommendations (especially the scope of regulations) also can be discussed. After the evaluation of constitutional jurisprudence regarding definition of law and other legal norms, which includes recommendations of prosecutor general, it can be concluded that recommendations are not suitable form for legal regulation of procedural activities and procedural relationships. In legal state all procedural relationships must be regulated by criminal procedure laws (codes). Therefore recommendations of Prosecutor General may not be defined as legal issues of criminal procedure as well as they are not obligatory for participants of criminal procedure. Recommendations of Prosecutor General often by their content and form are not in compliance with constitutional criterions of legality. Moreover there are no legal mechanisms for real and effective control of legality of said recommendations. [From the publication]
