LTTeismų sprendimai, priimti konkrečios valstybės teismo, kaip ir apskritai pozityvioji teisė, nepasižymi eksteritorialumu ir, nors ir įsiteisėja, savaime neįgyja teisinės galios už savo valstybės ribų ir negali būti pradėti vykdyti kitos valstybės teritorijoje. Tai iš dalies sietina ir su kiekvienos valstybės suverenitetu, ir su teismų jurisdikcija, kuri „baigiasi ties valstybės siena“ (išskyrus tarptautinių teismų bei tribunolų jurisdikciją). Tam, kad vienos valstybės teismo sprendimas, kurį būtina vykdyti kitos valstybės teritorijoje (nes ten, pavyzdžiui, gyvena atsakovas, ten yra jo turtas ar pan.), būtų pradėtas vykdyti, būtina dar viena procedūra, t.y. to teismo sprendimo pripažinimas ir leidimas jį vykdyti. Pripažinimas reiškia, kad užsienio valstybės teismo sprendimui kitos valstybės teritorijoje bus suteikta tokia pati teisinė galia, kaip ir tos valstybės teismų sprendimams, ir jis taps privalomas vykdyti. Straipsnyje nagrinėjamos Lietuos teismų sprendimų pripažinimo užsienio valstybėse galimybės bei skirtingi modeliai, pasirinkti atsižvelgiant į teismo sprendimo priėmimo momentą ir Lietuvos Respublikos bei konkrečios valstybės, kurioje sprendimą siekiama pripažinti ir įvykdyti, teisinius santykius. Taip pat aptariamos Lietuvos teismų sprendimų pripažinimo Europos Sąjungos valstybėse narėse reglamentavimo naujovės Lietuvai tapus visateise Europos Sąjungos nare. ENCourt judgements passed by a particular state and the positive law in general are not extraterritorial – even after coming into force, they do not acquire legal force outside the boundaries of the state and cannot be enforced on the territory of another state. This is partially related to the sovereignty of each state and the jurisdiction of courts, which “ends at the state border” (except for the jurisdiction of international courts and tribunals). In order to enforce the court judgement of one state that must be enforced on the territory of another state (e.g., if the defendant resides or has property there, etc.), an additional procedure is necessary; i.e. obtaining the recognition of the court judgement and the permission to enforce it. Recognition means that the court judgement of a foreign state will be accorded the same legal force on the territory of another state as that state’s court judgements and it will become enforceable. The article examines the possibilities of the recognition of the judgements of Lithuanian courts in foreign states, as well as the different models selected on the basis of the time of court judgement and the legal relations between the Republic of Lithuania and a particular state, from which the recognition and enforcement of judgements are sought. Furthermore, the article discusses the new aspects of the recognition of the judgements of Lithuanian courts in the EU Member States after Lithuania’s accession to the European Union.
