LTStraipsnyje atskleidžiamas teismo įgaliojimų savo iniciatyva keisti inkriminuojamos veikos kvalifikavimą griežtesniu ir konstitucinių (teisminio) baudžiamojo proceso tikslų bei principų santykis. Ar teismo įgaliojimai, nepaisant kaltintojo nuomonės, keisti inkriminuojamos veikos kvalifikavimą griežtesniu, yra suderinami su rungimosi, proceso šalių lygybės, teismo nešališkumo, teismo ir kitų proceso subjektų funkcijų atskyrimo, valstybės valdžios padalijimo principais? Valdžios padalijimo principai gali būti aiškinami kaip suderinami su teismo įgaliojimais savo iniciatyva pritaikyti baudžiamąjį įstatymą. Gali būti pateiktas neigiamas atsakymas, kai siekiama išspręsti konfliktą tarp kaltinimo ir gynybos. Konstitucinis teismas atkreipia dėmesį į baudžiamojo proceso tikslus. Pradėjus formuoti konstitucinę doktriną šiuo klausimu, pagrindiniu baudžiamojo proceso tikslu laikytas siekis pagrįstai ir teisingai nubausti kaltą asmenį. Tai gali būti prilyginama tikslui tinkamai įgyvendinti baudžiamąjį įstatymą. Tokiu atveju 1999 m. vasario 5 d. nutarimas, kuriuo teismo įgaliojimai savo iniciatyva pritaikyti sunkesnį nusikaltimą numatantį baudžiamąjį įstatymą pripažinti prieštaraujančiais Konstitucijai, gali būti vertinamas kaip nuokrypis nuo šio tikslo. Kad ir kaip būtų, pastarojo tikslo sureikšminimas sprendžiant teismo įgaliojimų savo iniciatyva griežtinti inkriminuojamos veikos kvalifikavimo klausimą aiškiai sulaužė kontinentinės Europos teisinę tradiciją Lietuvoje. Tai atliekant konstitucinėje doktrinoje jau buvo įvardyti įvairūs baudžiamojo proceso tikslai, neišskiriant reikšmingiausio.Todėl konstitucinis baudžiamasis procesas neteko iš pirmo žvilgsnio aiškios krypties. Šiuo metu remiantis vien Konstitucinio Teismo doktrinoje pateiktomis nuorodomis į konstitucinius baudžiamojo proceso tikslus, principus, tai ar jie pagrindiniai, tik apytikriai galima nuspėti Konstitucinio Teismo jurisprudenciją. Tačiau apie baudžiamojo proceso tikslus, didesnę ar mažesnę jų ir kartu atskirų principų reikšmę, aiškiau galima spręsti iš konstitucinės doktrinos nuostatų konkrečiais teisminio nagrinėjimo ribų kontrolės klausimais: ar ji suteikiama kaltinimui ir gynybai, ar teismui. Taigi vėlesnėje oficialiojoje konstitucinėje doktrinoje galima įžvelgti stiprėjančią (teisminio) baudžiamojo proceso tikslo tinkamai įgyvendinti baudžiamąjį įstatymą reikšmę. [...]. ENArticle reveals relationship among the powers of the court to re-qualify an act described in the indictment under more severe criminal law sua sponte and the objectives, principles of the constitutional (court) criminal procedure. Compatibility of the powers of trial court with (constitutional) principles of adversarial trial, equality of arms, independent and impartial tribunal, separation of powers, including powers of the court and the prosecutor depends upon the most important goal of the criminal procedure in general and criminal court proceedings in particular. The powers fit with the principles, if such goal is accurate implementation of criminal law. The answer is negative if the goal is solving of conflict between accusation and defense. The Constitutional Court pays regard to the goals of criminal procedure. Upon the formation of the constitutional doctrine the main goal was deemed to be the reasonable and just punishment of the perpetrator. This amounts to accurate implementation of criminal law. By the Ruling of 1999 February 5 the Constitutional Court of the Republic of Lithuania declared the aforementioned powers of the trail court to be in the conflict with the Constitution of the Republic of Lithuania. This Ruling can be seen as a deviation from the goal. However, the importance given to the goal of conflict solving clearly broke the continental European legal tradition in Lithuania. The constitutional doctrine adopted various goals of criminal procedure and it lost at first glance a clear direction. Currently solely on the basis of the Constitutional Court doctrine, the reference to constitutional criminal procedure aims, principles, whether they are basic or not, only marginally is of help to predict the jurisprudence of the Constitutional Court.However, the goals of criminal proceedings can be judged by evaluating the constitutional doctrine on the specific provisions concerning the control of the scope of the procedure: is it granted to the parties or to the trial court. In this way, the subsequent official constitutional doctrine can be seen as giving more importance to the goal of the implementation the criminal law. This forms the basis to believe in compliance of the powers of the trial court with the Constitution. By 2006 January 16 ruling the Constitutional Court streamlined the constitutional doctrine of the trail court powers to give orders to investigation (interrogation) officers to gather evidence which were declared unconstitutional by 1999 February 5 ruling. The Constitutional Court might consider compatible with the Constitution also the powers of court to re-qualify an act described in the indictment under more severe criminal law sua sponte, which were also held unconstitutional by the same ruling. The compatibility of the powers of the trial court with the Constitution could be based on the principles of active trial court, equality, justice and rule of law. Such evolution of the official constitutional doctrine should be encouraged by the fact that many continental European countries and the European Union member states authorize the court to re-qualify an act described in the indictment under more severe criminal law on its own initiative and international law per se does not forbid it. The aforementioned conclusions of the article are drawn from the analysis of the legislation in force, jurisprudence of the Constitutional Court, Lithuanian and foreign legal doctrine.
