LTStraipsnyje remiantis sisteminiu ir lyginamuoju metodais analizuojamas rungimosi principo turinys baudžiamajame procese, įvertinamas jo ir kitų teisės principų santykis. Jame, be kita ko, pateikiami dabartinėje Lietuvos teisės doktrinoje dar nenurodyti rungimosi principo aspektai baudžiamajame procese [...]. Pirmoji tarptautiškai pripažįstama rungimosi principo reikšmė baudžiamajame procese apima nuostatas, savaime išplaukiančias iš teismo pareigos išklausyti kaltinimo ir gynybos šalis. Kitos rungimosi principą baudžiamajame procese sudarančios nuostatos kildintinos iš draudimo teismui savo iniciatyva iškelti fakto bei teisės klausimus ir atlikti jų tyrimą. Tokia rungimosi principo samprata – pasyvaus teismo koncepcija iš esmės reiškia griežtą kaltinimo, gynybos ir teismo funkcijų atribojimą [...]. Rungimosi principas baudžiamajame procese tiesiogiai susijęs su teismo ir kitų proceso subjektų funkcijų atskyrimo principu, kildinamu iš valstybės institucijų atribojimo principo. ENThis article applies systematic and comparative methods of analysing the competitive principle in the criminal procedure, the relations governing it and evaluates other legal principles. Their application in Lithuania’s current legal doctrine does not yet indicate the aspects of the competitive principle of in the criminal procedure. [...] The first internationally recognised meaning of the competitive principle in the criminal procedure includes regulations which come from the court’s duty to hear the cases both for the prosecution and the defence. Other regulations governing the competitive principle in the criminal procedure include prohibiting the court from raising facts and legal issues at its own initiative. This understanding of the competitive principle essentially means that the prosecutor’s, defence’s and court’s functions are strictly delineated. [..] The competitive principle in the criminal procedure is directly related to court procedure and other procedures but separate from other principles originally from the principle of limiting the state institution. The competitive principle prohibits the court from beginning the procedure at its own initiative, extending the hearing of the case for the prosecutor to drop the charge, investigating circumstances additional to the case to force a confession from the defendant, sentencing too strictly or too leniently, sentencing more strictly than the prosecutor requires. [...]The competitive principle is examined on the basis of the European Court of Human Rights, the UN Human Rights Commission, the jurisprudence of the Supreme Court and legal doctrine governing the criminal procedure code.
