Summary / Abstract:

LTStraipsnyje nagrinėjamos konstitucinės justicijos instituto funkcionavimui reikšmingos konstitucijos ir įstatymo interpretavimo problemos. Šių aktų priklausymas skirtingiems nacionalinės teisės lygmenims, jų pobūdis, vieta bei reikšmė teisės sistemoje lemia jų interpretavimo ypatumus. Konstitucija - konstituciocentristinės teisės sistemos svarbiausia sritis, vienintelė pirminė teisė, priimta steigiamosios valdžios, nustatanti teisinio reguliavimo pagrindus. Jos normoms ir principams būdingas didžiausias normiškumo potencialas. Tai vienintelis aktas, kurio teisėtumas teisės sistemoje negali būti ginčijamas. Įstatymas - tik nustatyta tvarka priimtas įstatymų leidybos aktas, reguliuojantis išties svarbius santykius. Įstatyminis reguliavimas privalo atitikti konstitucijos normoms ir principams. Įstatymo negalima laikyti pirminiu teisės aktu, jis - ordinarinio lygmens aktas, išreiškiantis įstatymų leidėjo valią, kuri negali prieštarauti konstitucijai. Pasak autoriaus, konstitucija, kaip teisiškumo matas, gali būti interpretuojama, tik ją traktuojant kaip darnią principų ir normų sistemą, kaip teisę par excellence, prireikus konstituciniam teismui išlyginti šio teisinio akto “nelygumus“. Konstitucinis teismas visados konstituciją interpretuoja kaip idealią teisę nacionalinės teisės sistemos požiūriu. ENThe paper examines the problems of interpretation of the constitution and laws, which are significant for the functioning of the constitutional justice institution. Belonging of these acts to the different levels of national law, their nature, place and meaning in the legal system determine their interpretation peculiarities. The constitution is the key area of the constitutional-centrist legal system, the only primary law adopted by the constitutive government, establishing the basics of legal regulation. The greatest normative potential is characteristic of its norms and principles. This is the only act, the lawfulness of which cannot be questionable in the legal system. The law is the legislative act adopted at the prescribed procedure, which regulates very important relations. Legislative regulation must correspond to the constitutional norms and principles. The law cannot be considered the primary legal act; it is the act of ordinary level, expressing the will of the legislator, which cannot contradict the constitution. According to the author, the constitution, being the measure of lawfulness, might be interpreted only by treating it as a harmonious system of principles and norms, as law par excellence, if it is necessary for the constitutional court to flatten the “bumps” of this legal act. The constitutional court always interprets the constitution as the ideal law from the point of view of the national legal system. The specificity of interpretation of the constitution as the act, with regard to which the lawfulness of laws or secondary legislation is verified, is revealed by a special attitude to this act rather than by used interpretation methods.
