LTStraipsnyje nagrinėjamos Lietuvos Aukščiausiojo Teismo ir Lietuvos Vyriausiojo administracinio teismo konsultacijos, teiktos žemesniųjų grandžių teismų teisėjams siekiant formuoti vienodą teismų praktiką. Šios konsultacijos LR teisinėje sistemoje, o ypatingai teismų praktikoje, paplito ir netgi tapo masiniu reiškiniu nuo XX a. dešimtojo dešimtmečio vidurio. Teisiniu požiūriu aukščiausių teismų konsultacijos niekada nebuvo privalomos žemesnių grandžių teismams ar kitiems teisinio proceso dalyviams. Tačiau jos buvo (ir išlieka) svarbus, autoritetu pagrįstas teisės šaltinis. Vadovaujantis konsultacijomis sudaromos prielaidos mažiausiai pastangų ir kūrybos reikalaujančiu būdu, vykdant teisingumą, priimti sprendimą, kuris greičiausia, bus akceptuotas aukštesnės grandies teismo. Nors konsultacijos teisėjams yra tam tikra priemonė vienodinti teismų praktiką, tačiau kartu jos sąlygoja nemažai grėsmių. Konsultacijos formuoja pasyvų teisėjo tipą, nes kūrybišką teisės taikymą pakeičiamas mechaniniu konsultacijos atkartojimu. Konsultacijos nedera su teismų galiomis vykdyti tik kazualinį (konkretų) teisės aiškinimą, kuris tampa privalomu tik teisinio ginčo dalyviams. Konsultacijose teisėjams pateikiamas norminis (abstraktus) teisės aiškinimas ar formuluojama teisės akto taikymo taisyklė, tačiau tokios teismo funkcijos nedera su konstitucine teismo paskirtimi vykdyti teisingumą. Konsultacijos de facto veikia kaip faktorius, kuris daro nederamą įtaką ir spaudimą teisėjui priimant sprendimus, todėl turi būti vertinamos kaip pažeidžiančios konstitucinį teisėjų nepriklausomumo principą. ENThe article analyzes the guidance by the Supreme Court of Lithuania and the Lithuanian Supreme Administrative Court provided to the judges of inferior court units in order to develop a uniform practice of trials. These consultations spread and even became a mass phenomenon within legal system of the Republic of Lithuania and, particularly, in practice of trials, from the mid-nineties of the twentieth century. In legal terms, the guidance by the supreme courts has never been obligatory to the interior court units or other participants of legal proceedings. However, they were (and still remain) and important and legal source based on the authority. According to the guidance, the presumptions are made to decree by means of minimum efforts and creativity during the administration of justice, which is likely to be accepted by the superior court unit. Although the guidance are a certain means to unify the practice of trials, but together they cause a number of threats. The guidance form a passive type of judge, as the creative application of the law is replaced by a mechanical repetition of consultation. The guidance is not consistent with the power of courts to exercise only casual (specific) interpretation of the law, which becomes binding only to the participants of litigation. The judges are provided with standard (abstract) interpretation of the law or the rule for the application of act is formulated during the guidance, but such functions are incompatible with the constitutional mission of court to administer justice. The guidance de facto operate as the factor that has an inappropriate influence and pressure on the judge during the administration of justice, and therefore must be treated as a breach of the constitutional principle of judicial independence.
