Summary / Abstract:

LTDisertacija yra skirta teismo vaidmeniui vykdymo procese atskleisti. Civilinis procesas nesibaigia teismo sprendimo priėmimu. Tam, kad būtų realizuota teismo sprendimo teisinė galia, jis turi būti įvykdytas. Teisės į teisminę gynybą sudėtine dalimi pripažįstant teismo sprendimų vykdymą, svarbu, jog ir pats vykdymo procesas vyktų laikantis visų įstatymų nustatytų taisyklių ir teisės principų. Todėl teismo sprendimus vykdančių subjektų veikla turi būti detaliai reglamentuota įstatymu, jų veikla turi būti prižiūrima teismine tvarka. Teismui kaip valdžios institucijai valdingi įgalinimai suteikti ne tik valstybės vardu priimti sprendimus, bet ir užtikrinti priimto teismo sprendimo įvykdymą prievarta. Tyrimo objektas yra teismo vaidmuo vykdymo procese, teismo sprendimų vykdymo instituto istorinė raida, vykdymo proceso samprata ir teisinės jo prigimties problematika, vykdymo procese susiklostančių teisinių santykių bendrieji bruožai ir ypatumai bei teismo kontrolės funkcijų vykdymo procese procesinės realizavimo formos. Mokslo darbą sudaro įvadas, tyrimų apžvalga, darbo metodologija, keturios dėstomosios-tiriamosios dalys: „Teismo sprendimų vykdymo istorinė raida“, „Teisinė vykdymo proceso prigimtis“, „Teisinių santykių vykdymo procese struktūra ir atsiradimo pagrindai“, „Teismo funkcijos vykdymo procese“, išvados ir pasiūlymai, naudotos literatūros sąrašas bei autorės mokslinių publikacijų disertacijos tema sąrašas. Darbo pabaigoje atlikti moksliniai tyrimai bei gauti rezultatai apibendrinami ir pateikiamos pagrindinės išvados. [Iš leidinio]

ENThis dissertation focuses on the role of the court in the enforcement. The civil process does not end with the passing of a judgment. It has to be imposed for the legal power of the judgment to be realised. The essential parts of the right to legal defence to recognise the enforcement of the sentence is important that the enforcement process itself has to uphold all the established laws and legal principles. Thus, there must be detailed legal regulation governing enacting a court decision and its activity must be in accordance with legal procedure As a governing institution with powers, the court must not only pass judgments in the name of the state, but to ensure that enacting the court judgment passed is forced. The object of this research work is the role of the court in enforcement, the historical development of the enforcement institution, the concept of the process of enforcement and the relevant issues of its origin in law, general and specific features of legal relations of such enforcement and the forms of realising the procedure of court control functions in the enforcement. The research work comprises an introduction, outline of the research, methodology and four lecture-research parts: ‘Historical development of the court enforcement process’, ‘The nature of enforcement’, ‘The structure of legal relations in the enforcement and initial findings’, ‘Court functions in the enforcement’, conclusions and recommendations, and bibliographies. At the end, the research conducted and the results obtained are generalised and some basic conclusions drawn.
