Summary / Abstract:

LTKnygą sudaro trys dalys. Pirmojoje dalyje tiriamos darbo santykių teisinio reguliavimo Europos Sąjungoje ištakos ir raida, siekiant nustatyti šio reguliavimo atsiradimo priežastis, raidos bruožus ir tendencijas. Antrojoje dalyje analizuojamos Europos Bendrijos darbo teisės normų įtakos Lietuvos darbo teisei pirmosios prielaidos bei vertinama šių normų įtaka nacionalinei darbo teisei. Trečiojoje dalyje aptariamos skirtinguose teisės šaltiniuose įtvirtintų Europos Bendrijos darbo teisės normų perėmimo į Lietuvos teisę problemos, taip pat jų perėmimo ir atitikties kai kuriose teisinio reguliavimo srityse klausimai. Knyga turėtų būti vertinga nacionalinės darbo teisės reformuotojams, kurie turi spręsti konkrečių Europos Sąjungos darbo teisės normų perėmimo į Lietuvos teisę klausimus. Atlikto tyrimo rezultatai turėtų būti naudingi vykdomosios ar teisminės valdžios atstovams bei teisės praktikams, kurie jau pirmosiomis narystės dienomis susidūrė su Europos Sąjungos darbo teisės normų tiesioginiu veikimu ir taikymu Lietuvos Respublikoje. ENFunctioning of legal system of the European Union (hereinafter EU) inevitably raises the certain conditions to the states that wish to become a part of this system: they should adapt themselves to the valid rules and integrate into the existing system. The goal of the EU membership leads to the correction and modification of the goal and the content of the reform of the national legal system - it is important not only to create modem legal system but also adjust it to the EU membership. This goal is of special importance to the reformers of the Lithuanian labour law because quite a lot of legal norms regulating labour relations in the member states exist in the EU. Bearing in mind that Lithuania is going to join the EU in May 2004, it is compulsory to conduct a research if we are prepared to ensure their operation and application according to the requirements compulsory for a member states after joining the EU. That is why it is very important to analyse the legal basis of the integration of Lithuanian labour law into the EU legal system and ascertain if there are any problems of conformity between the EU labour law and Lithuanian legal norms that should be solved before membership. The main objective of the research work was to analyse and to evaluate the basis of the Lithuania’s labour law integration into the EU legal system, to identify the problems related to the correspondence of the Lithuania’s labour law to the requirements of the EU member states law and to propose the ways to solve those problems. To achieve this objective, the following tasks were accomplished.1. To investigate the reasons of emergence, development features and trends of the labour relations regulation in the EU legal system; 2. To single out the first preconditions of the impact of EU labour law norms on Lithuanian labour law and to present their full legal analyses; 3. To investigate the requirements to the national legal system imposed by the future EU membership and to describe the principles of takeover of legal norms established in the different sources of Community law; 4. To analyse the content of EU labour law norms regulating the certain groups of labour relations (free movement of workers, implementation of equality between men and women, information of employees of the conditions of employment, fixed-term agreements, collective dismissals, protection of workers rights in case of employers insolvency) and evaluate critically how the Lithuanian labour laws correspond to the requirements established by those norms, to identify the problems of conformity and to propose the ways to solve those problems.The scientific innovation of the research is revealed by the main research results: the reasons of emergence of labour relations regulation in the EU legal system, development features and trends are defined; Lithuanian labour law integration into the EU legal system grounds are singled out and their detailed legal analysis is presented; the methods of adoption of EU labour law norms into the Lithuanian law are presented and the ways to solve the problems related to correspondence of national legal norms to the separate EU labour law norms are proposed. The conclusions of the research and the proposals on their basis first of all should be valuable for the reformers of the national labour laws in the stage of the Lithuania’s preparation for the EU membership. The results of the research must be useful for the representatives of the executive and judicial authorities as well as for the legal practitioners who will face directly the direct application of the EU labour laws norms during the first day of the Lithuania’s EU membership. The research results presented in the work should be useful to the scientists, the persons maintaining their doctor’s papers and to the students investigating the EU or Lithuania’s labour laws. During the work the various methods of scientific research were used in the paper - logical analyses, systematic analyses, comparative, linguistic (grammar), teleological, historic and others.
