LTAutorė, remdamasi valstybės tarnybos ir valstybės tarnautojo sąvokomis, įtvirtintomis Valstybės tarnybos įstatyme, straipsnyje siekia išanalizuoti problemas, iškylančias atskiriant valstybės tarnybos ir darbo sutartimi grindžiamus santykius, nustatant darbo įstatymo taikymo ribas valstybės tarnybos srityje ir pateikti galimus įvardytų problemų sprendimo būdus. Tyrimas vykdomas analizuojant požymius, vienijančius ir skiriančius minėtus teisinius santykius. Valstybės tarnybos samprata nagrinėjama atsižvelgiant į užsienio valstybių praktiką reglamentuojant valstybės tarnybos santykius; aptariamos Europos Teisingumo Teismo jurisprudencijoje suformuluotos sąvokos ir taisyklės, naudojamos apibrėžiant valstybės tarnybos ribas. Autorė išskiria kai kurias problemas, su kuriomis susiduriama nacionalinėje teisėje atskiriant darbo sutartimi grindžiamus santykius nuo valstybės tarnybos santykių: išsamiai aptariamos galiojančių ir anksčiau taikytų vastybės tarnybą reglamentuojančių teisės aktų nuostatos. Nemažai dėmesio skiriama ir darbo įstatymų taikymo valstybės tarnautojams problematikai. Straipsnio pabaigoje autorė suformuluoja keletą pasiūlymų įstatymų leidėjui: siūloma papildyti valstybės tarnybos ir valstybės tarnautojo sąvokas nustatančias teisės normas reikalavimu, kad konkrečias funkcijas gali atlikti tik valstybės ar savivaldybės institucija ir įstaiga; įvardijama būtinybė aiškiai nurodyti, kada ir kokia apimtimi darbo įstatymuose nustatytos garantijos taikomos valstybės tarnautojams ir valstybės politikams. ENWith reference to the concepts of the public service and the public servant, as laid down in the Law on Public Service, the author makes an effort to analyse the problems arising when separating the relationships of the public service and employment contracts, determining the extent to application of the labour law in the area of public service and to propose potential solutions for the aforementioned issues. The study is structured on the analysis of attributes characteristic of the above-mentioned legal relationships and also on the features making such relationships distinct. The concept of the public service is elaborated taking into account the practice of foreign states in regulating the relationships of the public service; the definitions and rules formulated by the European Court of Justice used in defining the scope of the public service are discussed. The author identifies certain problems encountered in the national law when separating the relationships based on employment contracts from the relationships of public service: a detailed account is provided of the effective provisions regulating the public service and the provisions applied earlier. A lot of emphasis is also laid on the topics of applying labour laws to civil servants. The author formulates a few recommendations to the legislator at the end of the article: it is suggested to supplement the legal rules defining the terms of the public service and civil servants by the requirement that specific functions can be performed only by a state or municipal institution or agency; necessity to define specifically when and to what extent the guarantees laid down in labour laws are applied to civil servants and state politicians.
