Summary / Abstract:

LTStraipsnyje nagrinėjami pagrindiniai socialinės valstybės bruožai, socialinės valstybės doktrinos raidos aspektai. Siekiama parodyti, kad socialinės valstybės konstitucinis apibūdinimas, nors ir visapusiškai susijęs su žmogaus socialinių teisių ir laisvių formulavimo apimtimi konstitucijose, nėra lemiantis veiksnys apibūdinant socialinį valstybingumą. Analizuojant socialinių teisių ir laisvių istorinę raidą, atsigręžiama į Lietuvos konstitucinį paveldą ir daroma išvada, kad nors šiuolaikinėje Lietuvos Konstitucijoje nėra socialinės valstybės apibrėžimo, tačiau Konstitucijos normų visuma išreiškia valstybės socialinę orientaciją. Išskirtinai daug dėmesio skiriama oficialiajai konstitucinei doktrinai, kurią formuluoja ir plėtoja Konstitucinis Teismas. Konstatuojama, kad konstitucinėje jurisprudencijoje vis akivaizdesnė tendencija įžvelgti valstybės priedermes žmonių socialinės saugos srityje, suvienyti teisinės valstybės ir socialinės valstybės požymius į vientisą demokratinės valstybės sampratą. ENThe article examines the main features of the social state and some aspects of the development of the social state doctrine. The article argues that although the constitutional description of the social state is comprehensively related to the scope of human social rights and freedoms in constitutions, it is not the determining factor of social statehood. In analysing the historical development of social rights and freedoms, the article turns to the constitutional heritage of Lithuania and argues that, although there is no description of the social state in Lithuania’s current constitution, the entirety of the constitutional norms expresses the social orientation of the state. The article focuses particularly on the official constitutional doctrine, which is formulated and developed by the Constitutional Court. It is found that there is an increasing tendency in the constitutional jurisprudence to recognize the state’s duties in the area of social protection and merge the characteristics of the constitutional state and the social state into an integral concept of the democratic state.
