LTStraipsnyje analizuojama viena iš Lietuvos Respublikos civilinio proceso kodekso naujovių - galimybė nagrinėti bylas dokumentinio proceso tvarka. Autorius apžvelgia dokumentinio proceso raidą ir dokumentinio proceso modelį Vokietijoje, iš kur šio proceso idėja atkeliavo į Lietuvą. Remiantis šia analize keliama abejonė, ar Lietuvos įstatymų leidėjas pasirinko geriausią dokumentinio proceso modelį, leisiantį iš esmės paspartinti civilinių bylų nagrinėjimą. Straipsnyje nagrinėjamas rašytinių įrodymų vaidmuo dokumentiniame procese, aptariamos proceso spartinimo galimybės, vertinamas kai kurių dokumentinį procesą reglamentuojančių nuostatų tikslingumas ir prasmė. ENArticle is devoted to the analysis of the provisions of the Code of Civil Procedure of Lithuania, regulating the documentary procedure. The author looks over the historical development of the documentary procedure and highlights its dual nature by the example of corresponding legal regulation in Germany. Bearing in mind the merits of written evidence among the other evidentiary material, an interlocutory judgement, made on the basis of written evidence, is enforceable. Therefore the documentary procedure is to be considered as a kind of sui generis procedure, disposing features of both the judicial inquiry and execution. Since the idea of documentary procedure has come to Lithuania namely from Germany, the analysis of the Lithuanian model is carried out in comparison with the German one. As the documentary procedure of our country lacks any elements of execution, the author raises a doubt if this model will contribute to the achievement of a desirable effect - speeding - up the court proceedings. The expediency and rationality of some other provisions, such as prohibition of counter claim in documentary procedure of Lithuania, is analysed as well. [From the publication]
