Summary / Abstract:

LT2003 m. sausio 1 d. įsigaliojus naujajam Lietuvos Respublikos Civilinio proceso kodeksui (toliau - CPK), įtvirtinusiam didelę proceso formų įvairovę, teismų praktikoje imta aktyviai taikyti šio kodekso normas, reglamentuojančias teismo įsakymą bei dokumentinį procesą. [...] Išsamiau išskirti istorinę sumarinio proceso kilmę kol kas nebuvo mėginta, todėl tai bene pagrindinis šio straipsnio uždavinys. Sumarinis procesas padeda pasiekti didesnio teismo proceso sutelktumo bei ekonomiškumo, tačiau neretai susiduriama ir su kai kuriomis problemomis. Viena jų – tai aplinkybės, kai skolininko, atsakovo gyvenamoji, buveinės vieta yra nežinoma, paaiškėjimas jau teismui išdavus teismo įsakymą arba priėmus preliminarų sprendimą. Šios problemos aktualumą teismų praktikoje suponuoja intensyvus civilinių teisinių santykių subjektų mobilumas bei ganėtinai žemas verslo subjektų, ypač nedidelių įmonių, veiklos stabilumas, todėl straipsnyje nagrinėjamas proceso koncentruotumo ir tinkamo proceso principų santykis sprendžiant procesinių dokumentų įteikimo šiais atvejais klausimus. [...] Įstatymų leidėjas, įtvirtinęs CPK net keletą sumarinio proceso formų, ne visiškai pagrįstai nustatė iš esmės vienodą teismo įsakymo ir dokumentiniame procese priimamo preliminaraus sprendimo įsiteisėjimo tvarką, kuri kritikuojama ir teisės mokslininkų, ir praktikų. Straipsnyje į šią problemą mėginama pažvelgti per istorinę prizmę, pasitelkiant romėnų civilinį procesą, tarpukario Lietuvos patirtį, įvertinant kai kuriose užsienio valstybėse egzistuojantį sumarinį procesą. ENWhen the new Civil Procedure Code of the Republic of Lithuania (hereinafter – the CPC) came into effect on 1 January 2003, which established a great diversity of procedural forms, the court began active application of the norms of this code regulating court orders and document procedure. There have been no attempts so far to provide a more detailed analysis of the origin of the summary process and this article primarily aims to fill in the gap. Summary process helps achieve a greater concentration and efficiency of the legal proceedings; however, it often poses some problems as well. One of these problems arises when the debtor’s (the defendant’s) place of residence or domicile is unknown and it is found out already after the court has issues a court order or has made a preliminary decision. The importance of this problem in court practice is underscored by the intense mobility of the subjects of civil legal relations and the rather low stability of the functioning of business subjects, especially small companies. Therefore, the article examines the relation of the principles of concentration and proper procedure of the proceedings in solving the delivery of procedural document in the said cases. Having established even several forms of the summary process in the CPC, the legislator rather unreasonably set the same procedure for the coming into effect of the court order and the preliminary decision made in document procedure, which is subject to criticisms by both legal scholars and practitioners. The article attempts to look at this problem from the historical perspective by examining the Roman civil procedure, the experience of interwar Lithuania, as well as by evaluating the summary process in some foreign states.
