Summary / Abstract:

LTStraipsnis skirtas sumarinių procesų sampratos analizei. Autorius apžvelgia sumarinių procesų istorinę raidą ir konstatuoja, kad istoriškai šios bylų nagrinėjimo formos skyrėsi tiek savo istorinėmis ištakomis, tiek naudojamais proceso paspartinimo būdais. Dėl didelių įvairių sumarinio bylų nagrinėjimo modelių skirtumų straipsnyje vartojamas būtent terminas „sumariniai procesai“, o ne „sumarinis procesas“. Straipsnyje formuluojama sumarinių procesų sąvoka, apibūdinami šių procesų požymiai. Sumarinius procesus siekiama atriboti nuo kitų spartesnių bylos nagrinėjimo būdų, pasižyminčių kokybiškai kitais požymiais nei sumariniai procesai. Autorius analizuoja mūsų šalies CPK įtvirtintas bylinėjimosi formas ir pagrindžia galimybę kai kurias iš jų priskirti prie sumarinių procesų. [Iš leidinio]

ENArticle analyzes the concept of summary trials. The author views the historical development of the summary trials and comes to the conclusion that historically these forms of judicial proceedings differed in their origin, as well as in the methods used to speed up the trial. The "undefined" summary procedure, which had derived from the canon law, referred to the general rules of civil procedure, while the simplification of the proceedings was noticeable only in the possibility to derive from certain procedural provisions of a more formal nature. Meanwhile, the "defined" summary trial expressed one possibility or another to limit the examination of the case material. It originated from the Roman private law. Because of such essential differences in the various models of summary proceedings, the term "summary trials" is used in the article, instead of the term "summary trial". The article defines the summary trials and distinguishes the features of such trials. It also tries to distinguish the summary trials from other more speedy methods of judicial proceedings, which are determined by the increasing protection of public interest in the procedure and which have other qualitative features than the summary trials. The author analyzes the forms of trial, which are fixed in the Code of Civil Procedure of the Republic of Lithuania, and substantiates the possibility to refer the documentary procedure and cases involving the issuance of court orders, the adjudgment of insignificant sums and tresspassing upon the right of possession, to summary trials, because these forms of proceedings coincide with the features of summary trials discussed in the article.
