LTStraipsnyje atskleidžiama Seimo, kaip Tautos atstovybės, konstitucinė samprata, pateikiamos nuostatos, kuriomis grindžiama Konstitucijoje įtvirtinta Tautos atstovybės koncepcija. Analizuojamas Lietuvos Respublikos Seimo tęstinumas, aptariama sovietinės okupacijos laikotarpiu (1940-1990 m.) funkcionavusių vadinamųjų „Lietuvos TSR Aukščiausiųjų Tarybų" prigimtis, pagrindžiama, kodėl jos nėra ir negali būti laikomos Lietuvos valstybės parlamentais. Tyrinėjama Seimo nario priesaikos konstitucinė reikšmė, Seimo nario laisvo mandato konstitucinė samprata; atskleidžiamos konstitucinės nuostatos, kuriomis remdamasis Seimas gali ir turi nustatyti savo struktūrą ir darbo tvarką. Nagrinėjami iš Konstitucijos kylantys Konstitucinio Teismo įgaliojimai paneigti Seimo - Tautos atstovybės - valią, kuri atsispindi Seimo išleistuose įstatymuose, kituose teisės aktuose. ENThe article discusses the constitutional understanding of the Seimas as the representative body of the nation and presents the provisions which underlie the conception of the national representative body in the Constitution. The article analyses the continuity of the Seimas of the Republic of Lithuania, the nature of the so-called “Supreme Councils of the Lithuanian Soviet Socialist Republic” which functioned during the period of the Soviet occupation (1940-1990), and explains why they are not and may not be considered to be the parliaments of the Lithuanian state. The constitutional meaning of the oath of the members of the Seimas and the constitutional conception of the free mandate of the members of the Seimas are examined. The article discusses the constitutional provisions, on the basis of which the Seimas can and must organise its structure and work. Furthermore, the article examines the constitutionally-derived powers of the Constitutional Court to deny the will of the Seimas – the representative body of the nation, which is reflected in the laws and other legal documents adopted by the Seimas.
