LTXX a. 8–9 deš. Lietuva sukūrė mažumų teisių apsaugos režimą užtikrinti tradicinių etninių mažumų kultūrines teises. Svarbiausi šios politikos sprendimai buvo priimti iki Lietuvai pareiškiant norą tapti Europos Sąjungos (ES) nare, tad ES vaidmuo nebuvo lemiamas. Lietuvos mažumų teisių apsaugos reguliavimas, deja, neatnešė kultūrinių pokyčių, būtinų įtvirtinti mažumų teises. Dominuojančio tapatumo išsaugojimas tebėra vienas Lietuvos visuomeninio ir politinio gyvenimo prioritetų. Šiame straipsnyje analizuojama progresyvaus mažumų teisių apsaugos režimo raida Lietuvoje. Straipsnyje teigiama, jog Lietuvos atvejis liudija, kad vidaus veiksniai – istorinė patirtis ir Lietuvos elitų orientacija XX a. 8–9 deš. – formuojant mažumų teisių režimą buvo svarbesni nei tarptautinės įtakos. Nors buvo tam tikrų išimčių, tarptautinių veikėjų, įskaitant ES, įtaka Lietuvos mažumų teisių apsaugos režimui liko ribota. Sunku ES normas integruoti į nacionalinę teisės sistemą, kai visuomenėje nėra paramos tokioms normoms. Atvejo analizė leidžia daryti prielaidą, kad Lietuvos vidaus politikoje yra veikėjų, suinteresuotų ES ir Europos Tarybos propaguojamos etninės ir rasinės tolerancijos sklaida (pavyzdžiui, nevyriausybinės žmogaus teisių organizacijos), tačiau joms stinga galios paveikti mažumų politiką, kurios ištakos glūdi sovietinėje etninių grupių politikoje. Ši politika palanki vadinamosioms „tradicinėms“ mažumoms, įskaitant etninius lenkus ir rusus, bet neskatina progresyviai teisėkūrai būtinų kultūrinių pokyčių. ENIn the 8th-9th decades of the 20th century Lithuania created a safety regime for the rights of minorities to ensure the cultural rights of traditional ethnic minorities. The main decisions of this policy were taken before Lithuania declared its wish to become a member of the European Union (EU), therefore, the role of the EU was not crucial. Unfortunately, safety regulation of rights of minorities did not bring any cultural changes that were necessary to fortify the rights of minorities. Preservation of the dominant identity remains one of the priorities of Lithuanian social and political life. This article analyses the development of the protection of the rights of minorities in the progressive regime. The article states that the case of Lithuania shows that internal factors – historical experience and orientation of the 20th century 8th-9th decade elite - were more important while forming the regime of rights of minorities than worldwide impacts. Even though there were some exceptions, international players, including the EU, had a limited influence on the protection of the rights of minorities in Lithuania. It is difficult to integrate EU norms into the national legal system when there is no support for such norms in society. The analysis of the case lets to draw a conclusion that there were players in the internal policy of Lithuania who were interested in the spread of EU and European Council's ethnic and racial tolerance (for example, non-governmental law organizations), but they lack the power to influence the policy of minorities whose origins are in the politics of Soviet ethnic groups. This policy is beneficial for the so called "traditional" minorities, including ethnic Poles and Russians, but it does not promote cultural changes that are a must for a progressive law creation. Changes in Lithuania need a stronger civil society.
