Lietuvos Didžiosios Kunigaikštystės vyriausiasis tribunolas Vilniuje XVII ir XVIII amžių sandūroje – politinės kovos arena

LTStraipsnyje aptariami politiniai Lietuvos Vyriausiojo Tribunolo - aukščiausiosios teisminės institucijos veiklos XVII a. pabaigoje ir XVIII a. pradžioje aspektai. Tribunolo sesijos buvo svarbios ne vien tik teismų sistemos funkcionavimo požiūriu, bet ir kaip reikšmingas miestų, kuriuose rinkdavosi Tribunolas - Vilniuje, Minske ar Naugarduke, viešojo gyvenimo įvykis. Tribunolo politinė reikšmė ypač išaugo XVII ir XVIII a. sandūroje, kai Vyriausiasis Tribunolas atsidūrė Lietuvą apėmusių vidaus kovų epicentre. Politinės kovos peraugo į vidaus karą tarp Sapiegų grupuotės ir jų hegemonijai Lietuvoje iššūkį metusios bajorijos daugumos - vadinamųjų respublikonų, kurie darė tiesiogine įtaką Tribunolo funkcionavimui. Straipsnyje bandoma aptarti Tribunolo, kaip aukščiausios teisminės institucijos, gyvybingumą, aiškinamasi, ar vidaus konfliktai nesukėlė Vyriausiojo Tribunolo veiklos destrukcijos. Apariami bandymai reformuoti Tribunolą, sustiprinti jame bajorų savivaldos pradus. Analizuojamos didikų ir bajorijos grupuočių pastangos uzurpuoti Tribunolą, šią teisinę instituciją pajungti savo interesams. Parodomos grupuočių pastangos Tribunolo sesijų inauguravimo Vilniuje metu Tribunolo kontrole paimti į savo rankas, užtikrinti, kad butų išrinktas jiems palankus Tribunolo maršalas ar, pasinaudojant Tribunolo kontrole, įteisinti savo politinį dominavimą Lietuvoje, kas Lietuvos sostinę padarė grupuočių kovos epicentru.

ENThe article discusses political aspects in the work of the highest judicial institution in late 17th - early 18th centuries - the Lithuanian Supreme Tribunal. Political significance of the Tribunal has grown at the time and shifted to the epicentre of internal political battles in Lithuania. This period is known for the criticism of the work of the Tribunal, attempts to reform it or take under control and use its authority to legitimise power over the government of the Grand Duchy of Lithuania. The period in discussion is limited to two decades: from 1690 to 1710. The timeframe covers eve of the Civil War in Lithuania, aligned with the accumulation of critical events in the life of the nation in the last years of rule by the Kingjan III Sobieski (1690-1696), the Civil War in Lithuania (1697-1701) and the Great Northern Wat when various military encounters took place on the territory of the Grand Duchy of Lithuania (1701-1709). The article analyses how political and armed conflicts among groups of nobility and the Great Northern War had influenced situations when legitimacy of the Supreme Tribunal could have been called into question. One can see how sessions of the Tribunal were important not only to the functions of the judicial system, but also that they were important events in the public life of towns they were held in: Vilnius, Minsk or Navagrudak. Political battles turned armed conflicts between Sapieha grouping and the majority of Lithuanian nobility challenging their hegemony, the so-called republicans, had direct impact on the work of the Tribunal. The article attempts analysis of the vitality of the Tribunal as the highest judicial institution, trying to understand if internal conflicts were not an impediment to the work of the Supreme Tribunal. Attempts to reform the Tribunal and to strengthen rudimentary beginnings of self-government of the nobility are also discussed. [...].
