Summary / Abstract:

LTSvarbiausiose Europos Sąjungos bei tarptautinės teisės normose (Europos Sąjungos pagrindinių teisių chartijos 47, 48 str., Žmogaus teisių ir pagrindinių laisvių apsaugos konvencijos 6 str. 3 d. c p., Tarptautinio pilietinių ir politinių teisių pakto 14 str. 3 d. d p. ir kt.) būtinumas užtikrinti valstybės garantuojamą teisinę pagalbą grindžiamas „neturėjimu pakankamai lėšų“ teisės į teisminę gynybą realizavimui ir kai tai to reikalauja „teisingumo interesai“. Europos Žmogaus Teisių Teismo jurisprudencijoje įpareigojimas suteikti teisinę pagalbą, kai to reikalauja „teisingumo interesai“, yra siejamas su teisės pažeidimo sunkumu ir galimos bausmės griežtumu, taip pat su bylos sudėtingumu. „Bylos sudėtingumas“ Teismo sprendimuose suprantamas labai plačiai. Be kita ko, yra svarstomas ir asmens sugebėjimas be gynėjo pagalbos užtikrinti savo veiksmingą gynybą. Šiame kontekste darbe ir atkreipiamas dėmesys į socialiai pažeidžiamų asmenų (įtariamųjų, kaltinamųjų, asmenų, kurių atžvilgiu vykdomas priverčiamųjų medicinos priemonių taikymo procesas), t.y. turinčių negalią, teisės į gynybą užtikrinimą. Straipsnyje analizuojamas būtino gynėjo dalyvavimo užtikrinimas, kaip „mechanizmas“, kuris garantuoja asmeniui, turinčiam negalią, realią galimybę naudotis teise į gynybą, taip pat teise turėti gynėją. Darbo pradžioje nurodomos svarbiausios teisinės prielaidos; toliau išskiriamas diskusinis teisinio reguliavimo klausimas dėl Lietuvos Respublikos baudžiamojo proceso kodekso 51 straipsnio 1 dalies 2 punkto formuluotės; paskutinėje straipsnio dalyje akcentuojami teisinės pagalbos veiksmingumas (efektyvumas) bei savalaikiškumas.Minėti klausimai darbe aptariami, remiantis moksline literatūra, baudžiamojo proceso įstatymų, Europos Sąjungos teisės aktų, Europos Žmogaus Teisių Teismo, Lietuvos Respublikos Konstitucinio Teismo bei kitų nacionalinių teismų jurisprudencijos analize. ENObligation to ensure one‘s right to the legal advice, while it is required by "the interests of a fair justice“, in the jurisprudence of European Court of Human Rights is faced to gravity of the offence and severity of the possible punishment, as well as the complexity of the case. "Complexity of the case“ is widely understood in the case law of European Court of Human Rights. In Its practice, inter alia, it is discussed and argued about the ability of a person to ensure the effective defence of his/herself interests without a lawyer. This work takes into account the problems of implementing of the right to defence for the socially most vulnerable people (suspects, defendants, which are participating in the proceedings of application of compulsory medical treatment measures). The article focuses on the analysis of implementation of obligatory presence of counsel for the defence as "the mechanism“, that makes the ground for the person, which has any disability, to have a possibilty for using a councel for defence. In the beginning of this article, the main legal preconditions are delivered; next – the discussion on the legal provision of Subpara 2, Para 1 of Article 51 of the Code for Criminal Procedure is emphasized; the last part of the article focuses on the analysis of effectiveness and timeliness of the legal advice. Questions, mentioned before, are analysed by using scientific literature, legal provisions of the law on criminal procedure, legal provisions of European Union, jurisprudence of the European Court of Human Rights, Constitutional Court of the Republic of Lithuania and national courts.
