LTStraipsnyje tiriami viešojo intereso balanso Europos Parlamento ir Tarybos Reglamento (EB) Nr. 1049/2001, nustatančio visuomenės teisę susipažinti su Europos Parlamento, Tarybos ir Komisijos dokumentais, kontekste aspektai. Daug dėmesio skiriama išlygoms, ribojančioms bendroji viešąjį interesą, analizuoti, atskleidžiamos viešojo intereso testo taisyklės ir jų taikymo praktika. Daroma išvada, kad visuomenės teisės susipažinti su dokumentais efektyvumui turi reikšmės viešojo intereso sampratos neapibrėžtumas, tai, kad nėra bendrų viešojo intereso testo taisyklių, ir perteklinis išlygų skaičius. ENThe article analyzes public interest issues arising from the Regulation No 1049/2001 regarding public access to European Parliament, Council and Commission documents. In the context of contradictory proposals both to limit or expand the public right to access documents, it is necessary to reveal the concept of the public interest and it's application in the case law of European Court of Justice and General Court. The author defines the conceptual content of the public interest by examining the general meaning of the elements of the definition, and limiting it from synonymous concepts. The public interest is discussed in three aspects: as the fundamental principle of openness and transparency in the preamble of the Regulation, as the absolute exemption to the right to access documents, and as the overriding public interest in case of relative exemptions. To ensure the proper implementation of the concept of the public interest, the author proposes to define the public interest concept, to adopt common rules for the public interest test and to repeal the excessive exemptions.
