Manipuliavimo sporto varžybomis Lietuvoje teisinio reglamentavimo analizė

LTManipuliacija sporte ir manipuliavimas sporto varžybomis visame pasaulyje, kaip ir Lietuvoje, yra aktuali problema, ir tai yra viena didžiausių grėsmių šiandieniniam sportui, bei grėsmė Europos Sąjungos vidaus saugumui. Didėjanti sporto komercializacija turi įtakos legalių ir nelegalių lažybų pasiūlai, susijusiai su sporto renginiais, sporto varžybų įvykiais ir (ar) jų rezultatais, o dažnu atveju sporto šakų federacijų (toliau - sporto organizacija1) ir sportininkų finansinis nestabilumas – tai pagrindinės priežastys, lemiančios manipuliacijų sporto varžybomis paplitimą pasaulyje, įskaitant ir Lietuvą. Todėl Lietuvoje ypač svarbu turėti veiksmingą teisinį reguliavimą, atitinkantį manipuliavimo sporto varžybomis keliamas grėsmes ir tarptautinius įsipareigojimus, taip pat proaktyviai veikiančią institucinę sistemą su funkcinėmis priemonėmis, leidžiančiomis ne tik kovoti su manipuliavimu sporto varžybomis ir vykdyti jo prevenciją, bet ir aiškiai įvertinti esamą situaciją. Šio straipsnio tikslas – kompleksiškai išanalizuoti manipuliavimo sporto varžybomis teisinio reglamentavimo ir kovos su šiuo reiškiniu koordinavimo problemas, įvertinti aktualių teisės aktų taikymo praktiką bei atskleisti manipuliavimo sporto varžybomis sąvokos turinį, jos aiškinimą ir taikymą teisės doktrinoje bei praktikoje, taip pat išnagrinėti atsakomybės už manipuliavimą sporto varžybomis taikymo aspektus, identifikuojant su šiuo reiškiniu susijusius teisinio vertinimo ypatumus, probleminius klausimus ir praktinio įgyvendinimo sunkumus Lietuvos teisinėje sistemoje.Siekiant šių tikslų buvo analizuojami empiriniai tyrimai ir teisės aktai, taip pat nagrinėjami 2017-2025 m. laikotarpiu pradėti ikiteisminiai tyrimai dėl manipuliavimo sporto varžybomis (iš viso 18 ikiteisminių tyrimų, policijos ir prokuratūros priimtų nutarimų). Papildomai analizuoti 2014 ir 2023 m. atlikti sportininkų, trenerių, teisėjų, sporto vadybininkų ir kitų su sportu susijusių asmenų sociologinių tyrimų rezultatai, atspindintys manipuliavimo sporto varžybomis suvokimą ir paplitimą Lietuvoje. Tyrimo metu surinkti duomenys buvo sisteminami, lyginami, analizuojami ir apibendrinami. Tyrimo tikslams pasiekti buvo remtasi ir straipsnio autoriaus (Europol Supports Lithuania‘s Fight Against Match-Fixing)2 daugiau kaip 12 metų profesine patirtimi teisėkūros, teisės aktų taikymo, praktinio įgyvendinimo ir valdymo srityse, koordinuojant bei įgyvendinant kovos su manipuliavimu sporto varžybomis priemones. Ši patirtis sukaupta taikant Lietuvos pasirašytą ir ratifikuotą Europos Tarybos konvenciją dėl manipuliavimo sporto varžybomis (Makolino konvenciją), bendradarbiaujant su nacionalinėmis ir tarptautinėmis institucijomis bei dalyvaujant manipuliavimo sporto varžybomis prevencijos, tyrimo ir kontrolės procesuose. ENManipulation in sport and the manipulation of sports competitions around the world, as well as in Lithuania, is a pressing issue, and it represents one of the greatest threats to sport today, as well as a threat to internal security within the European Union. The increasing commercialization of sports influences the supply of both legal and illegal betting related to sporting events, sports competitions and/or their results, and in many cases, the financial instability of sports federations (hereinafter referred to as “sports organizations4”) and athletes. These are the main factors driving the prevalence of manipulation of sports competitions worldwide, including in Lithuania. Therefore, it is particularly important for Lithuania to establish effective legal regulations that address the threats posed by the manipulation of sports competitions and comply with international obligations, as well as a proactive institutional system with functional tools that not only enable the fight against and prevention of manipulation of sports competitions but also allow for a clear assessment of the current situation. The purpose of this paper is to comprehensively analyse the problems associated with the legal regulation of manipulation of sports competitions and the coordination of efforts to combat this phenomenon, to evaluate the current practice of applying relevant legislation, and to clarify the meaning of the concept of manipulation of sports competitions, its interpretation and application in legal doctrine and practice, as well as to examine aspects of the application of liability for the manipulation of sports competitions, identifying the specific features of legal assessment related to this phenomenon, problematic issues, and difficulties in practical implementation within the Lithuanian legal system.To achieve these objectives, empirical studies and legislation were analysed, and pre-trial investigations into manipulation of sports competitions initiated between 2017 and 2025 were examined (a total of 18 pre-trial investigations and decisions issued by the police and the public prosecutor’s office). In addition, the results of sociological surveys conducted in 2014 and 2023 among athletes, coaches, referees, sports managers, and other individuals involved in sports were reviewed to reflect perceptions of and the prevalence of manipulation in sports competitions in Lithuania. The data collected during the study was systematically organised, compared, analysed, and summarised. To achieve the objectives of the study, the author of the article (Europol Supports Lithuania’s Fight Against Match-Fixing) drew on more than 12 years of professional experience in the areas of legislation, enforcement, practical implementation, and management, as well as in coordinating and implementing measures to combat the manipulation of sports competitions. This experience has been gained through the implementation of the Council of Europe Convention on the Manipulation of Sports Competitions (hereinafter referred to as the “Macolin Convention”), signed and ratified by Lithuania, through cooperation with national and international institutions, and through participation in processes related to the prevention, investigation, and control of sports competition manipulation.
