Summary / Abstract:

LTInteresų konfliktų pasitaiko privačiame sektoriuje, nevyriausybinėse ar tarptautinėse organizacijose, universitetuose, mokslininkų, gydytojų, teisininkų, buhalterių ir kt. profesijų atstovų veikloje. Interesų konfliktų rezultatas yra šališkas, subjektyvus ir neskaidrus sprendimų priėmimas, netinkamas pareigų atlikimas. Viešajame sektoriuje pasitaikantys interesų susidūrimai tiesiogiai veikia valstybės valdymo ir visuomenės gyvenimo kokybę, visuomenės pasitikėjimo valdžia ir atskiromis jos institucijomis lygį, todėl sulaukia daugiau tyrinėtojų ir praktikų dėmesio nei panašūs atvejai kitų profesijų atstovų veikloje. Straipsnio dėmesio centre – interesų konfliktas ir jo reguliavimo praktika Lietuvoje. Straipsnio tikslas yra išanalizuoti teisinį interesų konflikto reguliavimą Lietuvoje. Trumpai pristatomos interesų konflikto ir su šia etikos bei teisės problema susijusios sąvokos, išskiriamos interesų konflikto formos ir rūšys, galiausiai pateikiama Lietuvos atvejo analizė. Trumpai aptariamas istorinis ekskursas į tarpukario Lietuvos teisinį šios problemos reguliavimą, vėliau išsamiai analizuojamos Lietuvos Respublikos viešųjų ir privačių interesų derinimo valstybinėje tarnyboje įstatymo nuostatos ir taikymas. Vertinamos trys įstatymo redakcijos, kurios leidžia aptikti pokyčius ir juos vertinti platesniu mastu. Taip pat skiriama dėmesio šiai problemai aptarti Lietuvos viešojo sektoriaus etikos kodeksuose. ENConflicts of interest do emerge in the private sector, non-governmental or international organisations, universities and in activities of scientists, doctors, lawyers, accountants and representatives of other professions. Conflicts of interests result in prejudiced, subjective and non-transparent decision making and improper performance of duties. Conflicts of interests in the public sector directly influence the quality of state governance and society's life, the level of public confidence in the authorities and their separate institutions, therefore, this issue attracts the attention of researchers more frequently than similar cases in activities of representatives of other professions. The article focuses on conflict of interest and its regulation practice in Lithuania. The aim of the article is analyse legal regulation of conflicts of interests in Lithuania. The concept of conflicts of interests as well as concepts related to these problems of ethics and law are briefly presented; types and forms of conflicts of interests are described and a Lithuanian case study is presented. The article briefly discusses the history of the legal regulation of this problem in interwar Lithuania, then thoroughly analyses the provisions of the Republic of Lithuania Law on the Adjustment of Public and Private Interests in the Public Service and application thereof. Three editions of the law, which allow identifying changes and assessing them in a wider context, are evaluated. The author also discusses this problem in codes of ethics of the public sector of Lithuania. The analysis allows claiming that in Lithuania, like in other Western democracies, activities of public servants is more controlled in case of a conflict of interests than activities of politicians.
