LTStraipsnyje nagrinėjama riboto valstybės imuniteto teorija, jos šaknys Lietuvos teisėje, atspindžiai teismų praktikoje, teorijos taikymo pagrindai, prielaidos ribotam valstybės imunitetui nuo užsienio valstybės jurisdikcijos, Lietuvos pozicija dėl užsienio valstybių imuniteto, taip pat pateikiamas kritiškas Aukščiausiojo teismo praktikos nagrinėjamu klausimu įvertinimas. Straipsnyje pateikiamos išvados, kad: Nors riboto valstybės jurisdikcijos imuniteto teorija yra įtvirtinta Lietuvoje, tačiau ji yra taikoma unikaliai, kas yra būdinga tik Lietuvos jurisprudencijai. Nors dar anksti teigti, jog Lietuvoje jau taikoma riboto imuniteto teorija tikrąja jos apimtimi, galima tikėtis jog Lietuvos Aukščiausiasis teismas ateityje sugebės visiškai atsiriboti nuo politinių įtampų ir gebės tinkamai vykdyti savo teismines funkcijas. Kadangi bylose, kuriose kyla įtampą dėl imuniteto nuo kitos valstybės jurisdikcijos taikymo, dažnai teismams yra sunku išvengti politinio spaudimo, riboto imuniteto teorija galėtų būti įtvirtinta, papildant Civilinio proceso kodeksą ar priimant atskirą įstatymą.Reikšminiai žodžiai: Valstybės procesinis imunitetas, Civilinis procesas.

ENThe article analyses theory of limited immunity of a state, its roots in Lithuanian law, reflections in legal practices, the basis of its application, preconditions for limited immunity of a state from the jurisdiction of foreign states, and the position of Lithuania towards the immunity of foreign states; and delivers critical assessment of practices by the Superior Court on this regard. The article concludes the following: although the theory of limited immunity of a jurisdiction of a state has been established in Lithuania it is applied with specific which is characteristic to Lithuanian jurisprudence only. Though it is too early to maintain that the theory of limited immunity is being already applied in Lithuania, we can expect that the Superior Court of Lithuania will be able to become completely dissociated from political pressure and duly perform its legal functions. Since courts often are hardly able to avoid political pressure in cases related to the immunity against the jurisdiction of the other state, the theory of limited immunity may be established by supplementing the Civil Procedure Code or adopting a separate law.
