Summary / Abstract:

LTStraipsnyje bandoma analizuoti 1992 m. LR Konstituciją ne vien kaip teisinį dokumentą, bet kaip aukščiausią norminę tikrovę. Šiuo požiūriu esminę reikšmę turi konstitucinės idėjos virtimas teisės aktu, teisės akto transformavimasis į konstitucinėje jurisprudencijoje išplėtotą konstitucinių normų ir principų sistemą [...]. Konstitucijos esmė atskleidžiama būtent per minėtas teisines transformacijas. XX a. Pabaigoje pagal konstituciją besitvarkančios visuomenės idėja į Lietuvą grįžo kaip viena iš kovos už valstybingumą idėjų. Rengiant 1992 m. LR Konstituciją darė įtaką Lietuvos konstitucinė tradicija, pasaulinis konstitucinis kontekstas, taip pat teisinės minties pasiekimai. Tiek Lietuvos Konstitucijos tekstas, tiek jo rengimo istorija patvirtina demokratinio konstitucionalizmo pasirinkimą. Tauta, įgyvendindama steigiamąją valdžią, 1992 m. spalio 25 d. Referendume pritarė Konstitucijai. Lietuvoje pirmąsyk įsigaliojo tiesiogiai veikianti norminė Konstitucija, turinti savo teisinės apsaugos mechanizmą. Tokia Konstitucija . aukščiausioji teisė, esmingai besiskirianti nuo ordinarinės teisės. Plėtojant konstitucinę sistemą ypač reikšmingas Konstitucinio Teismo indėlis. Būtent jo jurisprudencijoje formuluojamoje oficialioje konstitucinėje doktrinoje atskleidžiamas konstitucinio reguliavimo turinys ir prasmė. Konstitucinėje jurisprudencijoje konstitucinio reguliavimo potencialas įgauna baigtinę formą. Todėl dabartinė šalies konstitucija turi būti suvokiama kaip konstitucijos [...] neatsiejama jungtis su jo nuostatas aiškinančia oficialia konstitucinę doktriną. ENThe article makes attempts to analyze the Constitution of the Republic of Lithuania of 1992 not only as a legal document, but also as the highest normal reality. In this regard the transformation of the idea of constitution into a legal act and transformation of the legal act into a system of constitutional norms and principles, developed in the constitutional jurisprudence is of an essential significance [...]. It is the aforementioned legal transformations, where the essence of the Constitution is revealed. At the end of the 20th century the idea of a society, managing itself according to a Constitution returned to Lithuania among the ideas of fighting for statehood. The preparation of the Constitution of the Republic of Lithuania of 1992 was influenced by the constitutional tradition of Lithuania, the global constitutional context, as well as the achievements of law ideas. Both the text and history of preparation of Lithuanian Constitution evidence the choice of democratic constitutionalism. By Referendum, held 25 October 1992, the nation approved its directly functioning Constitution, the highest law with its own legal protection mechanism, which entered into effect in Lithuania for the first time and was essentially different from the ordinary law. When developing the constitutional system, the contribution of the Constitutional Court is of an especial importance. It is the official constitutional doctrine, formulated in the jurisprudence of the Constitutional Court where the content and meaning of constitutional regulation is revealed. The constitutional regulation potential in the constitutional jurisprudence acquires its finite form, therefore the presently existing Constitution of the state must be perceived as an integral connector of the Constitution [...] with the official constitutional doctrine, explaining its provisions.
