LTMokslo studija „Teisės į nuosavybę, teisės į ūkinės veiklos laisvę ir iniciatyvą, vartotojų teisių užtikrinimo problemos“ yra tyrimo „Žmogaus teisės Lietuvoje“ dalis. Atliekant tyrimą buvo išskirtos sritys, kuriose teisės į nuosavybę, teisės į ūkinės veiklos laisvę ir iniciatyvą, vartotojų teisių įgyvendinimas yra suvaržytas, subjektai patiria sunkumų naudodamiesi nurodytomis teisėmis, o kylančios problemos paliečia daugelį asmenų. Nuodugniau analizuoti žemės sklypų savininkų nuosavybės teisės ribojimai, Lietuvos Respublikos piliečių interesų apsauga nuosavybės teisių atkūrimo procese, teisės į ūkinės veiklos laisvę ir iniciatyvą nepriskyrimo žmogaus teisių katalogui problema, ūkio subjektams tenkanti didelė reguliavimo ir priežiūros našta, vartotojų teisių apsaugos politikos nenuoseklumas Lietuvoje bei šilumos paslaugų vartotojų padėtis. Apibendrinant tyrimo rezultatus, formuluojamos išvados ir rekomendacijos, kaip tobulinti analizuotų teisių apsaugą nurodytose srityse. ENThe peculiarities of the realization of the right to property, the right to freedom of individual economic activity and initiative, and rights of consumers in Lithuania during the period of 2008–2012 are analyzed in this study. In the course of the research two fields were identified where the right to property is heavily restricted in many respects and where arising problems have a negative impact on a big part of the population. The first field is connected with the rights of land owners. Analyzing the owners’ rights of the private forests and protected territories and the legal regulation of hunting the conclusion is drawn that restrictions of owners’ rights are disproportionate and the appropriate mechanism of compensation is missing. The second field is the ongoing process of the restoration of the rights of ownership to the real property where legal regulation causes the lack of free land, inappropriate and non-working mechanism of compensation for the state-redeemed land and the problems of administration of the restoration. The conception and content of the right to freedom of individual economic activity and initiative is disclosed in the study, also a correlation between this freedom and other human rights, first of all with the property right, is demonstrated.The analysis of the Lithuanian legal doctrine and practice, the lawmaking process, the political public discourse enables to ascertain that persons have difficulties to exercise the right to freedom of individual economic activity and initiative due to the fact that the said right sometimes is not perceived as human right to be protected. Numerous and constantly changing legal regulations that entrepreneurs have to adjust their activity to, is one of the main burdensome obstacles for the realization of the said right. The research also reveals that economic entities suffer from the activities of supervising institutions which lack the unified standards for control, supervision and consultation. In some supervision areas economic entities (legal or natural persons) do not have minimal procedural rights, although the sanctions in their size sometimes are equated to those of criminal nature. In the analysis of the realization and protection of consumer rights, two shortcomings are identified: the fragmentation in the policy and legal regulation of protection of consumer rights and deficiencies of the protection of rights and interests of persons using the services of the centralized heating systems. Proposals concerning the systemic revision of legal acts on consumer rights protection, as well as the revision of functions of state institutions authorized to protect consumer rights, first of all of State Consumer Rights Protection Authority, also concerning professionalism and accountability in the decision making process in the field of heating sector, are formulated.
