LTŠiame straipsnyje pateikiama ūkinės veiklos laisvės, įtvirtintos Lietuvos Respublikos Konstitucijos 46 straipsnyje, ir laisvės užsiimti verslu, įtvirtintos Europos Sąjungos pagrindinių teisių chartijoje, teisinė analizė. Straipsnio tikslas – ištirti minėtųjų laisvių sampratą ir apžvelgti praktikoje pasitaikančius probleminius veikimo ir aiškinimo aspektus pagal nacionalinę ir Europos Sąjungos teisę. ENBy its nature, the European Union and Lithuania National Law relationship is complex and influences new theoretical and practical challenges and questions. Freedom of economic activity, being one of the most important and most necessary public activities - is one of those questions. In the Lithuanian Constitution, Article 46, this freedom is named “freedom of economic activity“, and in 2004 Lithuania‘s accession to the European Union, Lithuania came into effect with one of the most important human rights legislation - the European Union Charter of Fundamental Rights, which Article 16 identifies freedom as “the freedom to conduct business“, it inexorably raises the question of how the freedom of economic activity is functioning in the national and supranational levels. On both cases, the freedom of economic activity according to their origin and nature are heterogeneous, linked to other human rights and freedoms, and is characterized by significant influence on the country‘s and the European Union‘s economy. By the practice of the Lithuanian Constitutional Court and the European Court of Justice the matter of freedom of economic activity is sufficiently developed. The article analyzes some of the cases, these courts represent different views and opinions of the essentially similar situations. This helps to reveal the freedom of economic activity between the versatility and potential objections. Therefore, this article is to investigate the economic activity and the freedom to conduct a business concept and practice of discovering frequent problematic aspects of its operation.
