LTStraipsnyje analizuojama „vacatio legis“ (lot. įstatymo nebuvimas) principo esmė ir jo taikymas mokesčių teisėje, atskleidžiant mokesčių vaidmenį polinėje bendruomenėje, jų įtaką asmenų elgesiui, galimybei rinktis tam tikras veiklos kryptis, jų teisėtiems lūkesčiams ir interesams. Straipsnyje atskleidžiamas „vacatio legis“ ir „lex retro non agit“ principų santykis. Tiriama „vacatio legis“ principo įtaka 2008 m. pabaigoje – 2009 metais padarytiems mokesčių įstatymų pakeitimams ir konstatuojama, kad šio principo taikymas buvo labiau išimtis nei bendra taisyklė. Nepaisant to, tokia praktika Konstitucinio Teismo formuojamoje doktrinoje pripažinta neprieštaraujančia Konstitucijoje įtvirtintiems teisėtų lūkesčių ir teisinės valstybės principams, kartu nustatant aiškias vacatio legis konstitucines gaires ir ribas būsimiems įstatymų leidėjo sprendimams. ENThis article deals with the principle of "vacatio legis" and its application in the field of taxes, revealing the role of taxes in the political society, the impact of tax policy on the behavior of taxpayers, their possibilities to choose certain trends of activity, their legal expectations and interests. The article also reveals the relation between the principles of "vacatio legis" and "lex retro non agit". The article analyses, how the principle of "vacatio legis" was applied during "night tax reform" made in Lithuania in the end of year 2008 and continued in 2009 and it is concluded, that the application of this principle was more an exception than a main rule. Nevertheless, the Constitutional Court of the Republic of Lithuania in its doctrine acknowledged that under specific circumstances this kind of practice does not contradict the Constitutional principles of legal expectations and state of law. The Constitutional Court also established clear constitutional guidelines for application of vacatio legis for the future decisions of the legislator. [From the publication]
