Coherence in criminal policy for offenses against justice that obstruct the investigation of a case

ENThe effective combating of crimes against justice is an indispensable element of every state’s criminal policy. Only by ensuring a safe environment for participants in criminal proceedings can a smooth criminal trial be expected. Therefore, the effective combating of crimes against justice requires coherence, both in criminal law and in the case law implementing it. Importantly, coherence between the provisions of the special and general part of the Criminal Code is essential for effective criminal policy. A lack of coherence between criminal law rules can lead to highly ineffective criminal policy. This analysis of both criminal law rules and case law shows precisely how a lack of coherence between criminal law rules leads to an ineffective and, in some cases, totally non-deterrent criminal policy in the fight against crimes against justice.
