LTStraipsnyje analizuojamos papildomos garantijos, taikomos nepilnamečiams kaltinamiesiems nagrinėjant bylas teisme. Visų pirma apibrėžiama nepilnamečio baudžiamajame procese sąvoka, konstatuojama, kad procesines garantijos gali būti taikomos tik tiems asmenims, kurie baudžiamosios bylos nagrinėjimo teisme metu nebuvo sulaukę 18 metų. Toliau apibrėžiamas Lietuvoje egzistuojančios nepilnamečių baudžiamosios justicijos modelis. Šis modelis palyginamas su pagrindiniais tarptautinėje teisėje įtvirtintais nepilnamečių justicijos principais ir aptariami konkretūs baudžiamojo proceso ypatumai, taikomi nagrinėjant teisme nepilnamečių padarytų nusikalstamų veikų bylas. ENLegal acts in the field of criminal justice introduce special provisions when juvenile responsibility is concerned. Constitutional principle of rule of law imposes a duty to ensure persons in the same legal position would have the same rights and obligations. The exception could be made in that case, when there exists such a difference between them, which can be considered as reasonable ground to establish different rules. Juveniles enjoy legal protection because of their psychophysiology and social characteristics. Also the negative outside factors can make a great influence on the juvenile's developing identity. The juvenile takes part in the criminal procedure only if he / she has obtained the age of criminal responsibility when commiting a crime. If he / she was underage then, the investigation cannot be started, and, if already started, has to be discontinued. In order to benefit from the special provisions the person must not reach the age of majority during the trial. Lithuanian juvenile justice system is classified as general criminal justice system, containing special rules applied to juveniles. The penal procedure code does not contain a separate, the provisions can be found next to rules which apply in general situations. The relevant provisions of Lithuanian penal procedure code are: the right to be informed about one' rights; opportunity to have non-public trial; the presence of the juvenile's guardian; obligatory presence of council; the presence of child protection agency or psychologist during the testimony.
