LTStraipsnyje, atsižvelgiant j tarptautines normas, remiantis užsienio valstybių praktika ir mokslininkų darbais, atkreipiamas dėmesys į svarbiausias problemas, kurių gali kilti siekiant pagal naujame Lietuvos Respublikos baudžiamajame kodekse įtvirtintas normas įgyvendinti Lietuvos baudžiamąją jurisdikciją. Straipsnyje nagrinėjamais klausimais pateikiamos teorinės išvados ir teikiami normų konstravimo siūlymai. Viena iš svarbiausių autoriaus išvadų yra ta, kad konstruojant nacionalinę valstybės baudžiamosios jurisdikcijos principų ir jų taikymą reglamentuojančių normų sistemą reikėtų atsižvelgti į tarptautines normas, doktrinos laimėjimus ir užsienio valstybių įstatymų leidėjo veiklos patirtį. ENThe article analyses the current problems of the application of the norms of the new Criminal Code of the Republic of Lithuania entrenching the principles of the State's criminal jurisdiction. The author admits, that every sovereign state is free in deciding, what principles should be used in the implementation of its criminal jurisdiction. At the same time, however, the author draws attention to the fact, that in the process of forming the national state's system of criminal jurisdiction principles and the norms, regulating their application, the international norms, achievements in the international law and national criminal law doctrine, as well as the legislation experience in foreign countries should be taken into consideration. The author, using the research methods those of systematic analysis, historical, comparative, criticism and others, analyses principles of the territory, State interest protection and State's criminal jurisdiction. The well-known principle non bis in idem is also analyzed in the article, the application aspects of which are important while deciding on the influence of the decisions adopted in foreign countries on the implementation of the Lithuanian criminal jurisdiction. While analyzing the norm entrenching the principle of territory, the author is critical about the fact, that this principle will be used in considering the acts, that have been carried out with the national flag of Lithuania or other Lithuanian insignia on ships or airplanes outside the borders of Lithuania. A judicious statement is made that the rules on identifying the criminal act place are regulated in the in the article, that is used for the principle of territory. According to the author, the identification of a criminal act place is important not only in the application of the principle of territory.The problem is also relevant in cases when extraterritorial jurisdiction is implemented, on the basis of one of the principles fixed in its Criminal Act. The article also stresses the fact, that the norms existing in the new Criminal Code do not provide a right to punish persons that have committed criminal acts on the Lithuanian continental shelf and in the exclusive zone by applying the criminal laws of Lithuania. The application of double criminality to the principle of State interests protection as well as the fact that the Lithuanian laws do not provision a possibility to revision the decisions adopted in foreign countries on acts committed outside the Lithuanian borders are also subject to criticism. The method of criticism is not an aim in itself, however, on the grounds that to questions analyzed the author provides conclusions of theoretical analysis to as well as submits suggestion on the construction of related norms.
