LTStraipsnyje analizuojami dvasininkų imuniteto baudžiamajame procese sampratos klausimai. Valstybės ir katalikų bažnyčios santykiai šiuolaikinėje valstybėje grindžiami ne tik humanizmo, savitarpio supratimo ar intervencijos draudimo principais, bet ir tikėjimo laisvės garantija. Kiekvienos valstybės socialinėje teisinėje veikloje, netgi ir baudžiamajame, privalo būti išlaikytas asmens teisių bei laisvių apsaugos primatas. Taigi, tiriant bei nagrinėjant baudžiamąsias bylas, nevisuomet gali būti iškeliamas nusikalstamų veikų išaiškinimo viešasis interesas, nesiskaitant su kai kurių asmenų asmeninio, profesinio pobūdžio interesais. Dvasininkų procesinė padėtis baudžiamajame procese užima gana svarbią vietą dėl to, jog šie asmenys didelę dalį informacijos sužino išpažinties patikėjimo jiems metu. Suteikus šiems asmenims garantuotą procesinį imunitetą, apsaugomi ne tik dvasininkų, bet ir didelės visuomenės dalies - tikinčiųjų - interesai. Todėl žmonės labiau pasitiki bažnyčia, valstybės požiūriu į tikėjimo laisvę. Vis dėlto praktikoje dažnai nesigilinama į klausimą, ar dvasininkui tikrai suteiktinas procesinis imunitetas, ar dvasininkas apskritai galėjo būti Atgailos sakramento subjektu. Tokiais atvejais dažnai pažeidžiama procesinė apklausos forma, vadinasi, pažeidžiami ir procesiniai liudytojų interesai. ENThis article analyses the conceptional problems of the immunity of clergymen in the criminal procedure. It should be emphasized the relation ships between the State and Catholic Church are based on the principles of humanity, mutual understanding, prohibition of interference and religious liberty. In the social legal activity of the State of Lithuania including the criminal procedure activity it has to be ensured the human rights primacy. There has to be the attitude of proportionality between the public interests and personal, professional interests in the case of pre-trial investigation and court hearings. The importance of immunity of clergymen has to be understood as the protection of society's interests, because of most part of information clergymen find out during the confession. After the interests of clergymen are protected, adequately the interests of religious part of society are protected. The mechanism of immunity of clergymen consists of the immunity's origin, effect and end. Those mechanism's elements has to be explained in the sense of factual and procedural immunity of the clergymen. The first immunity is definitely important one. It has to be defined as a prejudicial fact, which has direct influence on the procedural immunity's formation. The Code of Criminal Procedure strictly states the provisions of clergymen interrogation during the procedure. These provisions prohibit interrogation of clergymen. Clergymen can not be recognized as witnesses. After the clergymen were interrogated and the important information has been got, the court can not approve this information as important or as provable one. And this is because the procedural form of interrogation has been violated.To avoid this case, the Code of Criminal Procedure states the way of another kind of gathering information. In the consistence with the Code's provisions, every person can voluntarily and in their initiative provide the court, prosecutor office and pre-trial investigation institution with the information that is significant to the case.
