Summary / Abstract:

LTStraipsnyje apžvelgiamos žodžio ir spaudos laisvės principų atsiradimo aplinkybės pasaulyje, nagrinėjama spaudos laisvės padėtis Lietuvoje ir jos įtaka kuriant pilietinę visuomenę. Nuo 1864 m. Didžiojoje Lietuvoje buvo uždrausta raštija lotyniškais rašmenimis. Tad lietuviška spauda pasirodė Mažojoje Lietuvoje. Į Didžiąją Lietuvą nelegaliai gabenami lietuviški žurnalai Aušra, Šviesa, Varpas, Ūkininkas nebuvo cenzūruojami, leidėjai ir autoriai nesitaikė prie valdžios reikalavimų, galėjo kritikuoti caro administraciją ir vietinius valdininkus. Demokratinis nacionalinis judėjimas privertė Rusijos administraciją 1904 m. legalizuoti lietuvišką spaudą, tačiau ji turėjo derintis prie Rusijos įstatymų, egzistavo cenzūra ir griežtų bausmių sistema. Tik paskelbus Lietuvos nepriklausomybę 1919 m. priimtas pirmasis Lietuvos Spaudos įstatymas ir pirmoji mūsų Respublikos Konstitucija (1922) užtikrino spaudos laisvę. 1940–1988 m. sovietinėje Lietuvoje spaudos laisvės nebuvo, bet 1990 m. atkūrus Lietuvos Nepriklausomybę ir priėmus Spaudos ir kitų masinės informacijos priemonių įstatymą, Lietuvoje žiniasklaidos priemonės tapo laisvos ir necenzūruojamos. Žiniasklaida turi vadovautis Konstitucija ir įstatymais, humanizmo, lygybės, pakantos, pagarbos žmogui principais. Deja, Lietuvoje dažnai ji nesiskaito su žmogaus teisėmis, yra tendencinga, teikia melagingą informaciją, vengia paneigti ar patikslinti neteisingą, klaidinančią informaciją. Todėl reikia, kad žodžio ir spaudos, žiniasklaidos laisvę papildytų jos vartotojų laisvė rinktis, analizuoti ir daryti savo išvadas, tai yra būtina demokratinei pilietinei visuomenei. ENThe circumstances of the origination of the principles of freedom of speech and press in the world, the situation of the freedom of press in Lithuania and its influence on the formation of a civic society are reviewed in this article. Starting from the year 1864 the writings in the Latin alphabet was prohibited in Greater Lithuania. Therefore the Lithuanian press appeared in Lithuania Minor. Lithuanian magazines “Aušra”, “Šviesa”, “Varpas” and “Ūkininkas”, which were illegally transported to Greater Lithuania, were not censored, the publishers and authors did not conform to the requirements of the authorities, they could criticize the czarist administration and local officials. The national democratic movement made the Russian administration to legalize the Lithuanian press in 1904, however it had to be adjusted in accordance to the Russian laws, and the censorship still existed as did the system of severe punishments. Only after the declaration of Lithuanian Independence in 1919 the first Lithuanian Press Law was passed and the first Constitution of the Republic of Lithuania (1922). During the period from 1940 till 1988 there was no free press in the Soviet Lithuania, however after the restitution of Lithuanian Independence and after the adoption of the Law on press and other media the Lithuanian mass communication became free and uncensored. Lithuanian mass media has to follow the Constitution and other laws, also the principles of humanism, equality, tolerance and respect for humans. Unfortunately, the mass media in Lithuania often has complete disregard for human rights, it is biased, provides false information, and avoids denying or correcting the incorrect and false information. Therefore it is necessary to supplement the freedom of speech and press and mass media with the consumer freedom of choice, analysis and conclusion making as it is a prerequisite to the democratic civic society.
