Summary / Abstract:

LTKeičiantis mokslo paradigmai, neišvengiamai kyla klausimas, kokią įtaką naujasis – sudėtingųjų dinaminių sistemų – mokslas daro teisės mokslui. Labai svarbu, bandant atsakyti į šį klausimą, suvokti, kad teisės ir mokslo santykio klausimas vis dar yra svarbus. Todėl šiame straipsnyje pirmiausia siekiama pagrįsti teisės ir mokslo santykio problemos svarbą ir atskleisti pagrindinius naujojo mokslo paradigmos bruožus, o galiausiai – atsakyti į klausimą, kokią įtaką naujasis mokslas daro teisės mokslui. ENContemporary world experiences paradigm shift in science. Nowadays the new science “overthrows” the old one. The aim of the article was to reveal the main peculiarities of the new science paradigm substantiating the importance of the interrelationship of law and science and to establish its influence on the science of law. The research object was the new science paradigm and its relation to the science of law. Aiming to substantiate the importance of the relation between science and law we have come to a conclusion that law should be perceived as a complex dynamic system where it is impossible to find common and generally accepted answers, and what is more important, to predict behaviors. Only in this perspective scientists and practitioners will be able to recognize tendencies and make more balanced and deliberate decisions. Most importantly, they will understand that social systems cannot be studied in deterministic ways. This fact confirms that the problem of the relation between law and science is of great importance. Implementing the aim we have come to a conclusion that the new science – postmodern, the science of complex dynamic systems – does not make cognition possibilities absolute and makes it clear that every cognition depends not only on the limitation of the subject’s cognition, but also on the complexity, dynamics and variety of the context. The new science encourages combining sciences, common sense and social context so that we could perceive the reality not absolutely clearly, but more clearly. Law scientists have to understand that it is important to combine science with life and to use more methodologies in science, not just one.Answering the question about the influence of new science on law we suggest that the new science should not only provide accuracy and reliability of scientific cognition to law, but also approximate law to solving real problems, i.e. the science of law should be attributed human values, as well as the social and cultural context. However, as the new paradigm asserts, time will show which way of science and practice will be the firmest. [From the publication]
