LTVienas iš žmogaus teisės į teisingą bylos nagrinėjimą aspektų yra teisė į greitą baudžiamąjį procesą. Tačiau tinkamas bylos išsprendimas priimant teisėtą ir pagrįstą teismo sprendimą reikalauja laiko. Tad proceso trukmės klausimas yra labai jautri problema, nes susijęs su daugelio konkuruojančių interesų pusiausvyros nustatymu. Kiekviena valstybė, kuri pasirašė ir ratifikavo Žmogaus teisių ir pagrindinių laisvių apsaugos konvenciją, įsipareigojo kiekvienam žmogui užtikrinti, kad jo byla bus išnagrinėta per įmanomai trumpiausią laiką. Europos Žmogaus Teisių Teismas, kaip Konvencijos kontrolę užtikrinanti institucija, šį klausimą nagrinėja siekdamas nustatyti, ar laikas visose proceso stadijose buvo naudojamas tinkamai. Teismo praktikoje suformuluoti baudžiamojo proceso trukmės vertinimo kriterijai padeda nacionaliniu lygiu suvokti, ko reikia, kad atitinkamos bylos tyrimas atitiktų įmanomai trumpiausio laiko reikalavimą. Taip pat svarbu išsiaiškinti, ar nacionaliniu lygiu konkrečioje byloje konstatavus per ilgo proceso trukmę, galima pritaikyti efektyvias teisinės gynybos priemones. ENThe right to a fast criminal proceeding is one aspect of the right to a fair trial. Yet, an appropriate resolution of a case through the adoption of a legitimate and justified court decision requires time. The problem of the time of a judicial process is a very sensitive issue as it requires balancing a number of competing interests. Every nation which has signed and ratified the Convention for the Protection of Human Rights and Fundamental Freedoms has undertaken an obligation to ensure for every person that their case will be heard within the shortest possible time. As the institution in charge of controlling adherence to the Convention, the European Court of Human Rights investigates this issue with a view to determining whether time was used properly at all stages of a process. The criteria for evaluating the time of a criminal proceeding as defined by court practice help national authorities to understand what needs to be done in order for the investigation of a specific case to comply with the requirement of the shortest possible time. It is also important to ascertain whether effective legal defence remedies can be applied at the national level in cases when protraction of a judicial process has been established.
