Įrodinėjimo našta ir jos paskirstymas civiliniame procese : disertacija

LTMokslo tyrimo objektas yra įrodinėjimo našta ir jos paskirstymą civiliniame procese reglamentuojančios teisės normos, teismų praktikos bei kitų teisės šaltinių, susijusių su įrodinėjimo procesu, analizė. Disertacijoje siekiama kompleksiškai išanalizuoti įrodinėjimo naštos ir jos paskirstymo bendros taisyklės teorinius ir praktinius aspektus, nustatant esamus teisinio reglamentavimo trūkumus bei praktinio taikymo problemas ir pateikti jų tobulinimo pasiūlymus ir rekomendacijas. Pirmoji disertacijos dalis yra skirta įrodinėjimo naštos ir jos paskirstymo civiliniame procese ištakų bei teisinio reguliavimo skirtingais istoriniais laikotarpiais apžvalgai, kuri leidžia atskleisti tam tikrus tiriamo instituto dėsningumus, šalių ir teismo vaidmens įrodinėjimo procese pokyčius, sąlygotus politinių ir ekonominių veiksnių. Antrojoje disertacijos dalyje analizuojami teoriniai įrodinėjimo naštos ir jos paskirstymo civiliniame procese teisinės prigimties klausimai, o trečioji ir ketvirtoji dalys skirtos aptariamo instituto įgyvendinimo ypatumams bei problemoms aptarti. Teorinėje darbo dalyje nagrinėjama įrodinėjimo naštos ir jos paskirstymo samprata, turinys, reikšmė, tiesos bei įrodinėjimo standarto problema, lemianti įrodinėjimo naštos bei rungimosi principų koncepciją civiliniame procese. Kitose dalyse konkretizuojama įrodinėjimo naštos paskirstymo bendroji taisyklė, analizuojant jos turinį bei įgyvendinimo ypatumus kai kuriose civilinio proceso stadijose.

ENThe subject of the study is the burden of substantiation and the legal norms, regulating its distribution in civil proceedings, as well as the analysis of court practice and other legislation sources, pertaining to the process of substantiation. The thesis attempts at complex analysis of the theoretical and practical aspects of the common rules for the burden of substantiation and its distribution by identifying the existing deficiencies of legal regulation and the problems, pertaining to its practical application and presentation of the proposals and recommendations with regard to their improvement. The first part of the thesis is dedicated to the overview of the origins and legal regulation of the burden of substantiation and its distribution within the civil proceedings in different historic periods, which allows for revelation of certain regularities of the institution under study, the changes of the roles of parties and the court in the process of substantiation, determined by political and economic factors. The second part provides the analysis of the theoretical issues of the legal nature of the burden of substantiation and its distribution within the civil proceedings, the third and the fourth parts are dedicated to the discussion of the particularities and problems of implementation of the institute under discussion. The theoretical part of the study examines the concept, content and meaning of the burden of substantiation and its distribution, as well as the problem of the standard of substantiation, determining the concept of the burden of substantiation and the principles of contesting in civil proceedings. The remaining parts concretize the common rule of distribution of the burden of substantiation by analyzing its content and particularities of implementation in certain stages of civil proceedings.
