Dabartinės Lietuvos šeimos teisės modelio kūrimas tautinio atgimimo ir pirmaisiais nepriklausomybės atkūrimo metais (1988-1992)

LTStraipsnyje retrospektyviai apžvelgiami tautinio atgimimo metų ir pradinio laikotarpio atkūrus nepriklausomybę šeimos teisės idėjų raida bei politiniai, ekonominiai, socialiniai ir psichologiniai veiksniai, lėmę šeimos santykių formavimąsi. Remiantis to meto priimtais teisės aktais parodoma, kaip Lietuvos Konstitucijos projektuose, Aukščiausios Tarybos, Vyriausybės teisės aktuose, Lietuvos Respublikos Konstitucijoje kristalizavosi šiuolaikinės šeimos teisės idėjos. Nagrinėjama naujojo Santuokos ir šeimos kodekso rengimo pirmosios darbo grupės veikla. Teigiama, kad aptariamuoju laikotarpiu nuveiktas darbas kuriant šeimos santykių reguliavimo teisinę bazę tapo svariu indėliu kuriant dabartinį šeimos teisės modelį Lietuvoje. ENThe article provides a retrospective review of the development of ideas on family law during the national rebirth years and the initial period after the restoration of independence, as well as the political, economic, social and psychological factors that determined the formation of family relations. On the basis of the laws adopted during that period, the article shows how the contemporary ideas of family law evolved in the draft constitutions, the legal documents of the Supreme Council and the Government, and the Constitution of the Republic of Lithuania. The work of the first working group for the drafting of the Marriage and Family Code is examined. The article argues that the work done during this period in creating the legal base for the regulation of family relations made a significant contribution to the development of the current legal family model in Lithuania.
