Summary / Abstract:

LTStraipsnyje analizuojama muitinės sprendimų sąvoka bei jų apskundimo ir nagrinėjimo procedūra pagal Bendrijos ir Lietuvos teisę. Straipsnyje ginčai su muitine nagrinėjami lyginamuoju aspektu, lyginant juos su ginčais su kitu mokesčių administratoriumi - Mokesčių inspekcija. Analizuojama, kokie muitinės priimami sprendimai gali būti skundžiami, kaip tokie skundai nagrinėjami ir kokių padarinių sukelia ginčo su muitine inicijavimas. Straipsnyje daromos tokios išvados: - Muitinės priimtiems sprendimams, kurie gali būti skundžiami Bendrijos muitinės kodekse nustatyta tvarka, būdingi tokie esminiai požymiai: pirma, jie turi būti priimti muitinės, antra, jie turi būti susiję su muitų teisės aktų taikymu, trečia, sprendimai turi būti konkretūs, adresuoti suinteresuotam asmeniui ar asmenų grupei, ir ketvirta, jie turi sukelti teisinius padarinius, kurie pasireiškia tam tikrų įpareigojimų suinteresuotam asmeniui nustatymu. - Muitinės priimamų sprendimų apskundimo tvarka Bendrijoje reglamentuojama gana abstrakčiai. - Lietuvoje skiriami mokestiniai ir nemokestiniai ginčai su muitine. - Ginčo su muitine inicijavimas sukelia dvejopus padarinius. Viena vertus, bendra taisyklė, kad skundžiamo sprendimo įgyvendinimas nestabdomas, tačiau tiek Bendrijos teisėje, tiek Lietuvos nacionaliniuose teisės aktuose numatyta galimybė sustabdyti ginčijamo sprendimo įgyvendinimą (tiek pateikus garantiją, tiek jos nepateikiant). - Kita vertus, muitinės sprendimų įgyvendinimas tiek, kiek jis aktualus PVM ir akcizų atžvilgiu, stabdomas, vadovaujantis nacionaliniais teisės aktais, inicijavus mokestinį ginčą. ENThis article is intended to analyse, what is a customs decision, which can be appealed according to the rules of Community Customs Code. Such a decision has several specific features. Firstly, it must be adopted by customs office (authority responsible for applying customs rules). Secondly, a decision must be pertaining to customs rules; thirdly, a decision must be concrete, addressed to one or more specific identifiable persons. Finally, it must have legal effects, which means specific obligations for a particular person. After analysing the rules of Community and national law, it can be concluded, that the provisions of appeals procedure in the Community law arc quite broad and abstract. It is established, in which Member State an appeal must be lodged and stated, that it must be a two-step appeals procedure. That means that firstly the right of appeal is exercised before the customs authorities, subsequently, before an independent body (judicial authority or equivalent specialised body). In Lithuania two sorts of disputes with customs authorities can be identified: tax disputes and non-tax disputes. Tax disputes are those, which cause specific taxing legal effects on a person. Lithuania has chosen a mandatory pre-trial dispute settlement procedure.Firstly an appeal must be lodged before the customs authorities (Customs Department). Subsequently, an appeal can be lodged before the Commission of Tax Disputes (in case of a tax dispute) or before the Administrative Disputes Commission (in case of a non-tax dispute). While analysing the provisions of terms to adopt a decision and the procedure of suspending the examination of appeal, it can be concluded that tax disputes are considered as more complicated than non-tax disputes. The legal effects of lodging an appeal. As a general rule, lodging of an appeal does not cause implementation of the disputed decision to be suspended (in both tax and non-tax disputes). On the other hand, the Community law and the national law allow suspending the implementation of the disputed decision in some cases (with lodging a security or without it). [From the publication]
