Liudytojo procesinių interesų apsauga baudžiamajame procese: problemos ir perspektyvos : disertacija

LTDaktaro disertacijoje „Liudytojo procesinių interesų apsauga baudžiamajame procese: problemos ir perspektyvos“ tyrinėjami liudytojo teisinės padėties baudžiamajame procese sampratos ir šio subjekto procesinių interesų apsaugos klausimai. Disertacinio tyrimo objektas – liudytojo teisinė padėtis baudžiamajame procese, liudytojo instituto istorinė raida, liudytojo teisinė prigimtis, jo procesinio statuso klausimai. Ne mažiau svarbi tyrimo objekto dalis yra ir liudytojo procesinių interesų apsaugos tema, apimanti apsaugos paskirties, apsaugos priemonių sistemos, šių priemonių mechanizmo klausimus. Tyrimo objektas suponuoja ir paties tyrimo linkmę, t. y., pirmiausia, liudytojo teisinės padėties baudžiamajame procese teorinių pagrindų ir, antra, liudytojo procesinių interesų apsaugos analizę. Tyrime daroma prielaida, jog teisės aktuose numatytos liudytojo interesų apsaugos priemonės nėra pakankamos jo interesų apsaugai įgyvendinti. O esamų apsaugos priemonių praktinis taikymas taip pat kartais nebūna veiksmingas. Šiuo būdu, remiantis baudžiamojo proceso teisės ir kitų mokslų pasiekimais, disertacijoje analizuojami liudytojo teisinės padėties baudžiamajame procese teoriniai pagrindai, turintys įtakos šio subjekto procesinių interesų apsaugai, šios apsaugos samprata. Darbe siekiama įvertinti, kiek ir kaip šiuos klausimus atspindi baudžiamojo proceso įstatymų bei kitų teisės aktų nuostatos ir teismų praktika, taip pat nustatomi teisinio reguliavimo ir praktinio teisės normų įgyvendinimo trūkumai, siūlomi identifikuotų trūkumų pašalinimo, kitų nuostatų optimizavimo būdai. ENThe doctoral thesis ‘Protecting the witness procedure …….’ examines the concept/notion/understanding of the witness’ legal position in the criminal procedure and the protection issues relating to the procedural interests of the subject. The research object of this dissertation is the witness’ legal position in the criminal procedure, the historical development of the witness institution and issues relating to its procedural status. An equally important part of the research object is the topic of protecting the witness’ interests in the procedure, including protection ascribed protection systems and technical issues relating to these means. The study presupposes the direction it will take, i.e. first, the theoretical bases of the witness’ legal position in the criminal procedure and second, an analysis of the protection of the witness’ interests in the procedure. The presumption is made that the means of protecting the witness’ interests in the legal acts are insufficient to implement them and their practical application is not always effective. Thus, based on criminal procedure laws and other scientific/academic achievements, the dissertation analyses the theoretical foundation of the witness’ legal position in the criminal procedure and the influences it has on the protection of interest and the concept/notion/understanding of this protection. The study evaluates the extent to which these issues reflect the criminal procedure laws and other legal acts, statutes and court practice; the disadvantages of the established legal regulation and the practical implementation of norms of law, proposes eliminating the disadvantages identified, and other means of optimising the statutes.
