LTŠiame straipsnyje siekiama aptarti privalomosios mediacijos kaip vieno iš alternatyvių ginčų sprendimo būdų sampratą, mediacijos privalumus ir trūkumus, taikymo perspektyvas sprendžiant komercinius ginčus, atskleisti užsienio valstybių patirtį taikant privalomąją mediaciją, paanalizuoti praktines privalomosios mediacijos taikymo problemas. ENAll over the world the promotion of mediation in order for the parties to the dispute to resolve disputes that may arise promptly, confidentially and relatively inexpensively, without in any case not a perfect trial, without mandatory court’s decision, increases. However, we cannot state that today mediation is a popular mean to resolve disputes. 21 May 2008 the European Parliament and Council Directive 2008/52 / EC on certain aspects of mediation in civil and commercial matters provides that mediation process can be initiated by the parties or suggested or ordered by a court or prescribed by the Member State. According to the directive, mediation essentially may be in any form, i.e., both voluntary and mandatory. Various states have chosen different methods while implementing the provisions of Mediation Directive regarding mediation’s initiation forms, in respect to their own traditions, social, economic and legal situation, i.e. one state has chosen the classic model of voluntary mediation, others - in their legal system has made mediation mandatory.The analysis of foreign law on the application of mandatory mediation aspect, confirms that the country should establish mandatory mediation gradually, starting with certain categories of dispute. Drastic proposals to establish mandatory mediation procedures for the use of all disputes should be rejected. This article, among other things, seeks to reveal the application of mandatory mediation in both positive and negative aspects. After analysing and summarizing the aspects of mandatory mediation, it was concluded that this phenomenon is positive, but the consolidation of mandatory mediation in legal systems should be gradual and natural, it is necessary to show the benefits of mediation institute.
