Summary / Abstract:

LTVienas svarbiausių baudžiamojo proceso tikslų – materialios tiesos nustatymas, užtikrinant procese dalyvaujančių asmenų teisių ir teisėtų interesų apsaugą. Egzistuoja daug įvairių tiesos pažinimo (nustatymo) metodų, tačiau efektyviausias – tai baudžiamajame procese dalyvaujančioms šalims – gynybai ir kaltinimui suteikimas lygių teisių dalyvauti įrodinėjimo procese. Straipsnio objektas – proceso šalių lygių procesinių teisių įgyvendinimas ikiteisminiame tyrime. Straipsnio tikslas – išnagrinėti kai kurias ikiteisminio tyrimo metu kylančias šalių lygių procesinių teisių įgyvendinimo problemas. Straipsnio uždaviniai: apibūdinti šalių lygių procesinių teisių sampratą; apžvelgti šalių lygių procesinių teisių istorinę raidą ir atskleisti nagrinėjamo objekto šiuolaikinę esmę; apžvelgti kai kurias problemas, kylančias įgyvendinant šalių lygias procesines teises ikiteisminio tyrimo stadijoje. Rašant straipsnį buvo taikomi įvairūs teoriniai metodai. Kaip pagrindiniai paminėti sisteminės analizės, lyginamasis istorinis ir lyginimo. Be sisteminės analizės būtų nepavykę atskleisti šalių lygių procesinių teisių ryšio su baudžiamuoju procesu apskritai ir tiesos išaiškinimo, proceso dalyvių teisių apsaugos prielaidų ir garantijų. Taikant lyginamąjį istorinį metodą sugretintos atskirais laikotarpiais Lietuvoje taikytos nagrinėjamo objekto apraiškos formos, atskleista jų tarpusavio įtaka reformuojant baudžiamąjį procesą. Lietuvos baudžiamojo proceso įstatymai, moksliniai teiginiai, skirtingų autorių nuomonės lyginami su užsienio šalių pavyzdžiais. ENOne of the key objectives of the criminal procedure is the establishment of material truth, ensuring protection of the rights and lawful interests of the persons involved in the criminal procedure. There are a number of different techniques of discovering (establishing) the truth, yet the most effective is the provision of equal rights to the defence and prosecution. The article discusses enforcement of legal procedural rights of both parties during pre-trial investigation and examines several problems related to it. Furthermore, the article describes the concept of equal procedural rights of parties, makes an overview of how they developed historically, looks at the subject matter from the modern perspective and examines several problems related to the enforcement of equal procedural rights. The article was written applying a variety of theoretical techniques. The key ones included systemic and comparative-historical and comparative analyses. A systemic analysis was helpful in showing the link between the equal procedural rights of parties and the overall criminal procedure as well as the establishment of truth and protection of the rights of the parties in the criminal procedure and their guarantees. The comparative historical method put together the forms of the subject matter applied during different historical periods in Lithuania and showed their interrelation while reforming the criminal procedure. Further, Lithuanian criminal legislation, scientific statements and opinions of different authors were compared with the examples of foreign countries.
