Summary / Abstract:

LTŠiandien Lietuvoje autorių teisės įstatymų ir įstatymų įgyvendinamųjų teisės aktų lygmeniu yra gana detaliai sureguliuotos tiek specialiosiomis autorių teisės nuostatomis, tiek bendrosiomis civilinės teisės normomis. Vis dėlto, net praėjus septyniolikai nepriklausomybės metų ir vos ne dešimtmečiui po Lietuvos Respublikos autorių teisių ir gretutinių teisių įstatymo1 įsigaliojimo, autoriams ir kitiems teisių turėtojams neretai dar tenka įrodinėti savo teisių į literatūros, meno ar mokslo kūrinius egzistavimą, jų pagrįstumą, šių teisių teisinės apsaugos svarbą ne tik konkrečiam individualiam autoriui, bet ir visai visuomenei. Šioje monografijoje nėra svarstoma, ar autorių teises reikia saugoti - tai, mūsų nuomone, neginčytina. Norėta į autorių teises pažvelgti kiek kitaip, būtent kaip į turtą, kuriuo galima disponuoti. Juk teisinio reguliavimo tikslas - ne tik tam tikros teisės ar vertybės apsauga. Viena iš privatinių santykių teisinio reguliavimo paskirčių yra turtinių vertybių judėjimo iš vienų asmenų kitiems mechanizmų įtvirtinimas ir tinkamo jų veikimo užtikrinimas. Kūriniai ir autorių teisės į juos daugeliu aspektų skiriasi nuo tradicinio turto: pirma, kūriniams būdingas nematerialumas, antra, jie atsiranda kaip ypatingos intelektinės kūrybinės žmogaus veiklos išdava. Taigi monografijos tikslas - atskleisti, kaip šias autorių teisių objektų savybes atspindi autorių teisių perėjimo iš autoriaus leidėjui, prodiuseriui ar kitam teisių perėmėjui teisinis reguliavimas. ENThe monograph aims at the analysis of the peculiarities of the transfer of one of the types of intellectual property rights, the copyright, to the third persons. The analysis of the transfer of copyright, as provided for in the Republic of Lithuania Law on Copyright and Related Rights and the Civil Code of the Republic of Lithuania, to the third persons is important in several aspects. When examining peculiarities of civic turnover of copyright, one tries to disclose the essence of the copyright as an assignable property and the status of the author as the owner of property who has the right to use it and who enjoys the right to receive remuneration for the use thereof. There is another important aspect of this research as well - it is important to disclose not only the powers of holder of economic and moral author’s rights (owner of special property) to enjoy his rights, but also duties of the author who is subject to civil relations relating to the contractual successor in title or user of his rights, because exercising the economic and moral rights of the author should smoothly disgorge into the general entirety of civil relations, where one must protect and defend the interests of not only the author, but of the economic partner of the author who has to understand that copyright constitutes a property that may be used to meet the pecuniary claim against the author, too.The novelty of the monograph rests in the fact that in Lithuania it is the first systemic study of ways of copyright transfer to third persons, which analyses, by applying historical and comparative methods, the types of copyright and their specific features, reveals possibilities of transfer of copyright on the contractual basis, defines specifics of inheriting copyright and exercise of such inherited copyright, defines practical and theoretical problems of directing the recovery to the copyright, and establishes the status of copyright in the property of spouses. Therefore, the monograph may be useful to many people: those who study law, legal practitioners, and the authors themselves. The monograph comprises the introduction, two parts: "Types of Copyright and Their Specific Features", "Ways of Copyright Transfer to Third Persons", as well as conclusions and proposals. In the first part "Types of Copyright and Their Specific Features" one reveals the concept of copyright and examines personal moral and economic rights of the author. In the first chapter “Moral Rights” one examines the moral rights, the process of development of their legal regulation, specific features of these rights: termless period of their validity and no possibility to transfer them, as well as inter-relation of personal moral rights and economic rights of the author.The study revealed that links between the moral and economic rights of the author, transfer of economic rights, practical purpose of the work, transfer of the right of ownership of the material expression in which the work is embodied results in the fact that non-transferability of moral rights of the author is not absolute and should be interpreted flexibly, while taking into account the content of the copyright agreement, balance of interests of the author and the successor in title or owner of the material expression in which the work is embodied, as well as practical and functional purpose of the work. However, the non-transferability of the said rights as provided in the Law on Copyright and Related Rights prohibits the author’s absolute waiver of moral rights or agreeing on their exercise in the way, where the author would totally loose control of the implementation of the moral rights relating to the works created by him. In the second chapter "Economic Rights of the Author" one analyses the concept of economic rights of the author, their specifics and legal regulation. Economic rights of the author are aimed at gaining the economic benefit from the use of the work. These rights are exclusive, except the cases provided for by the law, when the author enjoys the right of remuneration, they have been transferred, divided and have limited period of validity. Every exclusive economic right, which is specified in the Republic of Lithuania Law on Copyright and Related Rights, implies the use of the work in several ways that may be an independent element of the copyright agreement. Alongside the economic rights of the author are interrelated, therefore quite often a contractual transfer of one economic right implies the transfer of another right and this is made in order to achieve the purpose of the contract.
