LTStraipsnyje nagrinėjama techninių priemonių naudojimo kriminalinėje žvalgyboje teisinio reglamentavimo atitiktis Lietuvos Respublikos Konstitucijai bei Europos žmogaus teisių ir pagrindinių laisvių apsaugos konvencijai. Pabrėžiamas būtinumas tikslinti Lietuvos Respublikos kriminalinės žvalgybos įstatyme įtvirtintus techninių priemonių panaudojimo bendra tvarka atskyrimo nuo techninių priemonių panaudojimo specialia tvarka kriterijus. Taip pat nemažai dėmesio skiriama techninių priemonių naudojimo kriminalinėje žvalgyboje teisinio reglamentavimo problemoms. Keliami kritiniai prievartinių priemonių naudojimo tvarkos nustatymo neviešo pobūdžio teisės aktais klausimai. ENThe article presents the analysis of the juridical preconditions of the use of technical equipment during criminal intelligence. A particular focus of research is drawn on the compliance of the juridical regulation of the use of technical equipment during criminal intelligence with the main provisions of the Constitution of the Republic of Lithuania and the European Convention for the Protection of Human Rights and Fundamental Freedoms. The problems of the distinguishing the use of technical equipment by general procedure and the use of technical equipment according to special procedure are directly related to the lack of certainty and clarity of the criterions provided by Law on criminal intelligence of the Republic of Lithuania. Indeterminacy and uncertainty of above mentioned criterions raise contradictions due to modern doctrine for the protection of human rights and freedoms. The author highlighted the importance to revise criterions provided by Law to distinct the use of technical equipment by general procedure and the use of technical equipment according to special procedure. Critical remarks due to the order for the use of measures of coercion provided by the restricted by-laws are also being mentioned. Accessibility of the Law making provision of the grounds and minimum safeguards for the use of coercion measures is the issue of great importance. The author concludes that the use of technical equipment in controlling or recording personal conversations and other communications or actions, even when one of the participants in the conversation, other communications or actions, is aware of such control and it is being implemented in accordance with the procedure established by laws, while restricting the inviolability of the private life of an individual requires a reasoned court ruling.Compliance with the main requirements provided by the Constitution of the Republic of Lithuania and the European Convention for the Protection of Human Rights and Fundamental Freedoms for the justified interfering of human rights and freedoms during the criminal intelligence inter alia depends on the adjusted and provided by Law concepts of the use of technical equipment by general and according to special procedure. The interfering of the human rights and fundamental freedoms has to be the main criterion for distinguishing the use of technical equipment during criminal intelligence by general procedure and the use of technical equipment according to special procedure. Incompliance with this criterion lets to conclude that definitions provided by the Law of the criminal intelligence of the Republic of Lithuania must be adjusted. [From the publication]
