The importance of private interest for implementing person and property security

LTStraipsnyje, remiantis empirinių tyrimų duomenimis, parodomas santykis tarp privataus ir viešojo intereso užtikrinant asmens ir turto apsaugą, analizuojama privati saugos rinka Lietuvoje bei privačių saugos struktūrų vieta asmens ir turto saugos srityje. Autorius kelia idėją dėl privačių saugos struktūrų dominavimo ginant ne tik privačius, bet ir viešuosius asmenų saugumo interesus. Dėl šio priežasties pastebimas privačių saugo struktūrų skverbimaisi į viešojo saugumo sritį. Kita vertus, rinkos ekonomikos sąlygomis riba tarp viešojo intereso ir privataus intereso bei juos saugančių institucijų (policijos ir privačių saugo struktūrų) nėra aiški, nes privataus subjekto saugomos vietos tampa viešosiomis erdvėmis, o jas saugantys pareigūnai yra mišrios formos (privačios saugos, policijos ir pan.). Daroma išvada, jog privataus intereso reikšmė įgyvendinant asmens ir turto saugą priklauso nuo valstybės nacionalinių, ekonominių, socialinių – politinių ir teisinių veiksnių. Tai leidžia susiaurinti viešojo intereso dominavimą ir viešojo saugumo subjektų funkcijas bei atitinkamai išplėsti asmens ir turto saugos paslaugas teikiančių privačių saugos struktūrų kompetenciją. Atitinkamai turėtų keistis ir valstybės politika privačių saugos struktūrų atžvilgiu, kuri pasireikštų per teisinio reguliavimo mechanizmo sukūrimą ir konkurencingų sąlygų su viešosiomis saugos tarnybomis vykdant analogiškas funkcijas sudarymą. ENThe article, on the grounds of empirical research data, shows the relationship between the private and the public interest in ensuring the protection of the person and property, studies the private market of security services and the place of private security structures in the area of protection of persons and their property. The author puts forward the idea of dominance of private security structures protecting not only private but also public security interests. Consequently, it is observed that private security structures are trying to make their way through into the area of public security. On the other hand, the borderline between the public and private interest and institutions protecting them (the police and private security structures) is not clear, because the locations protected by private entities become public spaces and the officers carrying out such services come from mixed-form structures (private security services, the police, etc.). It is concluded that the significance of the private interest in ensuring personal and property security depends on the national, economic, social-political and legal factors of the state. It allows limiting the dominance of the public interest and the functions of public security entities and, accordingly, extending the powers of private security structures that provide the security services for persons and property. Consequently, the national policy in respect of private security structures should also change and be implemented through the creation of the mechanism of legal regulation and opportunities to compete with public security services in the performance of identical functions.
