Summary / Abstract:

LTStraipsnyje nagrinėjamas Europos socialiniu dialogu sudaryto Susitarimo dėl minimalių reikalavimų tipinėms profesionalių futbolininkų sutartims įgyvendinimo efektyvumas. Visų pirma straipsnyje atskleidžiama Europos socialinio dialogo, kaip autonomiško reguliavimo instrumento, pranašumai ir trūkumai. Taip pat analizuojama Susitarimo 5 straipsnio reikšmė, profesionalių futbolininkų teisių užtikrinimas nacionaliniu lygmeniu. Galiausiai straipsnyje nagrinėjamas Susitarimo 5 straipsnio įgyvendinimo Lenkijoje, Kroatijoje, Slovėnijoje ir Lietuvoje efektyvumas. ENThis paper analyses the effectiveness of the implementation process of the autonomous Agreement on minimum requirements in standard player contracts concluded within the European social dialogue committee for European professional football. The paper reveals pros and cons of the autonomous social dialogue regulation and highlights that the effective implementation of Article 5 of the Agreement, which regulates labour relationship between a player and a club, could contribute to better protection of rights of the most vulnerable footballers. The analysis showed that Article 5 of the Agreement is not implemented in Poland, Croatia, Slovenia and Lithuania due to legal and practical reasons. This implies that the implementation process of the autonomous Agreement is not effective at the national level. [From the publication]
