Summary / Abstract:

LTDėl valstybės intervencijos į ekonomiką būtinumo plėtojant naujus energetikos, kelių tiesimo, su urbanizacija susijusius projektus vis dažniau kyla klausimas, kur yra privačios nuosavybės teisės ribojimo ribos. Straipsnyje analizuojama, kaip Konstitucinio Teismo formuojama nuosavybės ri¬bojimo doktrina kito nuo jo įsteigimo 1993 m. iki dabar. Atskleidžiama, kuriais atvejais ši doktrina sudarė prielaidas plėsti privačios nuosavybės teisės gynybos apimtį, o kada ji buvo siaurinama. Daroma išvada, kad nuosavybės, nuosavybės teisės sampratos turinys, nuosavybei priskiriamos funkcijos turi įtakos privačios nuosavybės teisės ribojimui. Atskirai analizuojama, kokiems objek¬tams ir subjektams yra taikoma konstitucinė nuosavybės teisės garantijų apsauga, parodoma, kad yra aiški Konstitucinio Teismo tendencija didinti objektų ir subjektų, kuriems taikoma nuosavybės teisės apsaugos garantijos, ratą. Nuosavybės ribojimo pagrindai suskirstomi į tris grupes pagal tai, iš ko jie kyla: vieni expressis verbis – iš Konstitucijos, kiti – iš konstitucinio įstatymo, treti – iš įstatymo (ne konstitucinio), ir atskirai analizuojami. Nagrinėjama, kokie bendri konstituciniai reikalavimai kyla įstatymų leidėjui nustatant nuosavybės teisės ribojimus. Atskirai plačiau vertinamas nuosavybės teisės ribojimas paimant nuosavybę visuomenės po¬reikiams, kuris siejamas su viešuoju interesu. Parodomas viešojo intereso apibrėžimo problemiš¬kumas, teismų vaidmuo vertinant, ar priimti teisės aktai dėl nuosavybės teisės ribojimų atitinka jiems keliamus konstitucinius reikalavimus, inter alia įvertinant, ar yra viešasis interesas. ENDue to the necessity for the state to intervene in economy when new projects related to energy, road building, and urbanisation are developed, the question of the limits of the restrictions on the right of private ownership is faced in an increasing number of situations. In the light of this, the article analyses how the doctrine formulated by the Constitutional Court in relation to the limitation of ownership has been changing since the Constitutional Court’s establishment in 1993 until the present. The analysis discloses the cases in which the said doctrine created preconditions for expanding the scope of the defence of the right of private ownership and in which—it was narrowed. The conclusion is drawn that the contents of the concepts of ownership and the right of ownership, as well as the functions attributable to ownership, have had influence on the limitation of the right of private ownership. A separate enquiry into objects and subjects falling under the constitutional protection of the guaranties of the right of ownership shows that the Constitutio¬nal Court has had a clear tendency to expand the range of the objects and subjects that enjoy the guarantee of the protection of the right of ownership. In the article, the grounds for the limitation of ownership are analysed by dividing them into three groups depending on the sources that they stem from: i.e. whether they stem expressis verbis from the Constitution, from a constitutional law, and a law (rather than a constitutional law). The analysis also covers the general constitutional requirements that arise for the legislator in the course of establishing restrictions on the right of ownership.A more detailed attention is specifically devoted to the assessment of the limitation of the right of ownership through the expropriation of property for public needs, where the latter means is lin¬ked to the public interest. In this respect, the analysis reveals the problems encountered in relation to the definition of the public interest, as well as underlines the role of courts, in deciding whether the adopted legal acts concerning the limitation of the right of ownership are in line with the applicable constitutional requirements, inter alia in assessing the existence of the public interest.
