Summary / Abstract:

LTLR nepriklausomos valstybės atkūrimas suponavo ne tik galimybę, bet ir būtinumą atkurti pažeistas piliečių teises. Konstitucijoje nėra tiesiogiai įtvirtinta, kad valstybė turi pareigą atkurti nuosavybės teises į turtą, kuris okupacijos laikotarpiu buvo nacionalizuotas ar kitaip neteisėtai nusavintas. Ši pareiga valstybei atsiranda tik tada, kai valstybė ją prisiima. Valstybė gali spręsti, į kokį turtą atkurti pažeistas nuosavybės teises, nustatyti nuosavybės teisių atkūrimo sąlygas, būdus, tvarką. Pradėjusi nuosavybės teisių atkūrimą valstybė gali keisti nustatytą teisinį reguliavimą, tačiau ji yra saistoma konstitucinio teisinės valstybės principo, kitų Konstitucijos normų ir principų, inter alia teisėtų lūkesčių apsaugos principo. Tai reiškia, kad pagal įstatymus pradėtas restitucijos procesas įgijo konstitucinę apsaugą. Pagal įstatymus, galiojusius iki 1990 m. kovo 11 d., nuosavybės teisės negalėjo būti atkurtos, todėl šiam tikslui buvo priimti specialūs įstatymai. Reguliuojant nuosavybės teisių atkūrimą reikėjo atsižvelgti į tai, kad jau yra susiformavę nauji socialiniai, ekonominiai, turtiniai santykiai, todėl buvo pasirinktas ne restitucio in integrum, bet dalinės restitucijos kelias. Atkuriant nuosavybės teises prioritetas teikiamas išlikusio nekilnojamojo turto grąžinimui natūra. Jeigu nuosavybės teisių negalima atkurti grąžinant turtą natūra, jos gali būti atkurtos kitais įstatyme numatytais būdais. Tai, kad kai kuris [...] nusavintas turtas nėra grąžinamas natūra, nereiškia, kad tai yra prilyginama nuosavybės paėmimui visuomenės poreikiams, kaip numatyta Konstitucijos 23 str. ENCreating the independent state of the Republic of Lithuania presupposed the possibility and necessity of restoring the citizens’ violated rights. The Constitution does not directly establish that the state has the responsibility to restore property and assets which were nationalised or otherwise unlawfully taken during the occupation. This responsibility arose only when the state undertook it. The state can decide which assets can be restored and establish the conditions, manner, and procedure fordoing so. When the process of restoring assets begins, the state can change the established legal regulation, however, it is obliged to follow the constitutional rights principle and other constitutional norms and principles, inter alia principles of protecting lawful expectations. Thus, according to the law, the restitution process that has already begun has become a matter of constitutional protection. Under the law that applied until 11 March 1990, property rights could not be restored because special laws had been passed to ensure such. When regulating the restoration of rights it was necessary to consider that new social, economic, and assets relations had already been formed thus it had been chosen ne restitucio in integrum but as a partial route to restitution. Having made the restitution of property rights a priority, the whole nature of restituting property had to be provided. If property law cannot allow property restitution, it can be done through other laws. Some assets that were removed are not of a returnable nature – this does not mean that they have the same status as property taken for the society’s needs, as indicated in article 23 of the Constitution.
