LTIeškinio institutas yra vienas iš svarbiausių civiliniame procese, nes konstitucinė žmogaus teisė kreiptis teisminės gynybos negali būti įgyvendinama bet kokia tvarka. Kartais yra net teigiama, jog be ieškinio nebūtų nei teisminio bylos nagrinėjimo, nei iš viso civilinio proceso. Nors dėl ieškinio svarbos ir nėra ginčijamasi, tačiau to negalima pasakyti, kalbant apie vieningą ieškinio sąvokos apibrėžimą ir sampratą. Šiuo metu yra vyraujančios trys ieškinio esmės teorijos. Vadovaujantis pirmąją teorija, reikia išskirti dvi savarankiškas ieškinio sąvokas – materialine teisine ir procesine teisine prasme. Materialine teisine prasme ieškinys šioje teorijoje yra suprantamas kaip reikalavimas atsakovui, kuris yra materialinės teisės institutas. Procesine teisine prasme pagal šią teoriją ieškinį galima apibūdinti kaip ieškovo kreipimąsi į teismą ir reikalavimą apginti turimą subjektinę materialinę teisę. Tokiu atveju ieškinys yra procesinės teisės institutas. Antroji teorija yra labai panaši į pirmąją, nes ji apjungia procesinę ir materialinę ieškinio prasmes į vieną. Taigi ši ieškinio esmės teorija vadinama mišriąja. Straipsnio autorė laikosi nuomonės, jog tinkamiausia yra vadovautis trečiąja teorija, pagal kurią ieškinys yra laikomas išimtinai procesine kategorija ir savarankišku civilinio proceso teisės institutu. Straipsnyje taip pat yra analizuojamos ieškinio rūšys. Svarbiausios ieškinių klasifikacijos yra išskiriama pagal tris kriterijus: ieškinio tikslą, gynimo objektą ir ginamąjį interesą. ENThe institute of claim is one of the main ones in a civil process as the constitutional right of a human being to appeal for judicial defence cannot be exercised in just any manner. It is sometimes even being said that without a claim there would be no court hearing or civil process at all. Although the significance of claim is not disputed, same thing cannot be said about the definition and understanding of a singular concept of claim. At this point, there are three prevailing theories of the essence of claim. According to the first theory, two stand-alone concepts of claim must be identified in the material/legal and procedural/legal sense. In the material/legal sense, the theory construes claim as a demand towards the defendant, which is the institute of material law. In the procedural/legal sense, claim can be described according to this theory as the claimant’s appeal to the court and demand to defend their subjective material right. In this event, claim is the institute of procedural law. The second theory resembles the first one a lot, as it unites the procedural and the material senses of claim and is hence called the “mixed” theory. The author believes that the third theory is the most appropriate as it construes claim as an exclusively procedural category and an independent institute of civil process law. The article also analyses the types of claim.
