The Soviet agression against Lithuania in January 1991 : international legal aspects
LTLietuvos Respublikos nepriklausomybės atkūrimas 1990-aisiais metais ir 1991 metais sekę įvykiai pasižymėjo tuo, kad Lietuvai teko susidurti su Sovietų Sąjungos agresija. Straipsnio autorius nagrinėja 1991 metų Sovietų Sąjungos vykdytos agresijos prieš Lietuvą įvykius ir pateikia jų įvertinimą tarptautinės teisės aspektu. Autorius analizuoja Lietuvos Respublikos nepriklausomybės atkūrimo įvykius ir neigiamą Sovietų Sąjungos reakciją, 1991 metų sausio ir po jo sekusius Sovietų Sąjungos veiksmus. Pateikiamas šių įvykių bei Lietuvos tarptautinio statuso vertinimas, atskleidžiamas nepasisekusios Sovietų Sąjungos agresijos poveikis tolimesniam Lietuvos ir Rusijos bendravimui ir tarpusavio pripažinimui. Galiausiai analizuojamas tarptautinės teisinės atsakomybės dėl 1991 metų sausio įvykių klausimas. Autorius plačiai naudoja istorinius faktus, remiasi Europos Žmogaus Teisių Teismo praktika, Lietuvos ir užsienio valstybių teisės aktais, sutartimis, kitais oficialiais dokumentais ir pareiškimais. Vertinant Sovietų Sąjungos ir Lietuvos veiksmus tarptautinės teisės požiūriu, yra akivaizdu, jog 1991 metų įvykiai turi būti laikomi Sovietų Sąjungos agresijos aktu, kadangi Lietuvos Respublika niekada nebuvo teisėta Sovietų Sąjungos dalimi. Taigi, 1991 m. įvykiai buvo Sovietų Sąjungos bandymas reokupuoti Lietuvą. ENThe restoration of the independence of the Republic of Lithuania in 1990 and the subsequent events in 1991 were distinguished by the fact that Lithuania had to face the Soviet Union’s aggression. The author of the article analyses the events, related to the Soviet Union’s aggression against Lithuania in 1991, and assesses them from the perspective of international law. The author analyses the events, related to the restoration of the independence of the Republic of Lithuania, and the negative reaction of the Soviet Union, the actions of the Soviet Union in January 1991 and their subsequent actions. The assessment of these events and of Lithuania’s international status are provided, the impact of unsuccessful aggression of the Soviet Union on further communication between Lithuania and Russia and mutual recognition is revealed. Finally, the issue of the international legal responsibility with regard to the events of January 1991 is analysed. The author broadly uses historical facts, bases his work on the practice of the European Court of Human Rights, legal acts of Lithuania and of foreign states, treaties, other formal documents and statements. When assessing the actions of the Soviet Union and Lithuania from the perspective of international law, it is obvious that the events of 1991 should be considered an act of the Soviet Union’s aggression because the Republic of Lithuania has never been a legitimate part of the Soviet Union. Hence, the events of 1991 were the Soviet Union’s attempt to re-occupy Lithuania. Moreover, such aggression should be viewed from an international perspective not only as actions that cause purely legal and financial consequences, but also as actions that impose moral and political responsibility.
