Summary / Abstract:

LTŠiame moksliniame straipsnyje nagrinėjama Lietuvos Respublikos Konstitucija, atsižvelgiant į garsiąją Vienos teisės teorijos mokyklą. Autorius pabrėžia, kad 1920 metų Austrijos Konstitucijos pagrindinis kūrėjas buvo vėliau garsus visame pasaulyje teisės teorijos mokslo atstovas Hansas Kelzenas. Šis mokslininkas teigė, kad teisė, atsižvelgiant į jos glaudų ryšį su teisės normomis, turi būti aiškinama tik normatyviniu, o ne religijos, ideologijos požiūriu. Vėliau tokį teisės nagrinėjimo pobūdį išplėtė kiti teisės mokslininkai (Alfred Verdross, Adolf Merkl) ir tai dabar vadinama Vienos teisės teorijos mokykla. Šio mokslinio straipsnio autorius Lietuvos Respublikos Konstituciją nagrinėja pirmiausia struktūros požiūriu ir pabrėžia, kad šio teisės akto struktūra rodo, kad ji buvo priimta po išsivadavimo iš Sovietų Sąjungos okupacijos. Paskui autorius analizuoja Konstitucijos preambulę, atkreipia dėmesį ir giria, kad joje labai išreikšta tai, kad tauta priėmė Konstituciją. Straipsnyje tiriami ir tam tikri Konstitucijos skirsniai. Autorius atkreipia dėmesį, kad Lietuvoje žmogaus teisėms ута skiriamas ne pirmasis, o antrasis skirsnis. Aptardamas žmogaus teises, autorius pažymi, jog Konstitucijoje pabrėžiami tokie egzistenciniai dalykai: kad valstybė rūpinasi žmonių sveikata, valstybė ir kiekvienas asmuo privalo saugoti aplinką nuo kenksmingo poveikio. Galiausiai autorius analizuoja galimybes kontroliuoti, kaip laikomasi Konstitucijoje įtvirtintų reikalavimų, ir teigia, kad tiek Lietuvoje, tiek Austrijoje nuo Hanso Kelzeno laikų yra įsteigti konstituciniai teismai. Paskutinėje straipsnio dalyje aptariami padaryti Lietuvos Respublikos Konstitucijos pakeitimai. ENThis scientific article analyses the Constitution of the Republic of Lithuania with regard to the famous Wien School of Legal Theory. The author highlights that the main creator of the Constitution of Austria of 1920 was the representative of the world known science of legal theory Hans Kelzen. This scientist claimed that law, considering its close relation with legal norms, must be interpreted from the normative and not religious and ideological point of view. Later this nature of legal interpretation was enhanced by other scientists and now it is called the Wien School of Legal Theory. The author of this scientific article analysed the Constitution of the Republic of Lithuania from the point of view of structure and highlights that the structure of this legal act indicates that it was adopted after the liberation from the Soviet occupation. Then the author analyses the Preamble of the Constitution and draws the reader’s attention to the fact that it highlights the fact that the nation adopted the Constitution. The author draws the reader’s attention to the fact that in Lithuania human rights are discussed in the second section, and not in the first one. When discussing human rights, the author notes that the Constitution highlights the following existential things: the state must take care of its people’s health, the state and every person must protect the environment from any harmful effect. And finally the author analyses the possibilities for controlling the adherence to Constitutional requirements and claims that constitutional courts have established in Lithuania and Austria since the time of Hans Kelzen. The last part of the article discusses the amendments introduced to the Constitution of the Republic of Lithuania.
