LTXVI a. I pusės Lietuvos Didžiojoje Kunigaikštystėje (LDK) teismo procesui būdingas rungimasis su tam tikromis archainių papročių „apeigomis“. Formalią teismo ginčo pradžią simbolizavęs išorinis gestas ir buvo kepurės statymas. Teismo procese – tai momentas, kada, nustačius ginčo objektą, pereinama prie įrodymų pateikimo. XV a. pabaigos–XVI a. vidurio dokumentai patvirtina, kad kepurė dažniausiai buvo statoma, teisybės įrodymui pasitelkiant liudytojus. Tačiau jau XVI a. I pusėje liudytojus keitė dokumentai, t. y. rašytiniai įrodymai, kuriems Pirmasis Lietuvos Statutas teikė prioritetą. Nors paprotinė kepurės statymo norma nebuvo įrašyta į Statutą, tačiau XVI a. I pusėje įvairiuose LDK teismuose ji buvo taikoma, vadinasi, teisėjų pripažįstama teisėta. Kepurės statymo paprotys istoriografijoje siejamas su užstato (vadium) institutu, tačiau ši problema kelia bene daugiausia diskusijų, nes XVI a. pradžios teismų dokumentuose statantieji kepurę vis rečiau minėjo užstatą. Tuo tarpu XVI a. I pusės valdovo ir komisorių teismų medžiaga liudija užstatą „kepurėje“ tikrai dar egzistavus; jo dydis bei vertė, išreikšta ne tik pinigais, labai įvairavo ir priklausė nuo bylininkų ekonominės ir socialinės padėties. Nors stebima ryškėjanti statančių kepures su užstatais skaičiaus mažėjimo tendencija, vis dėlto akivaizdus XVI a. I pusės LDK bajorų prisirišimas prie konservatyviais papročiais ir tradicijomis pagrįstos teisėtvarkos ir nenoras atsisakyti protėvių sukurtos verbalinės teisinės kultūros. ENThe court trials in the Grand Duchy of Lithuania (GDL) in the early 16th c. were characterized by the competition with some archaic “rites”. Placing a hat was the outward gesture that signified the formal beginning of a court dispute. In the judicial process, this is the time when after the establishing the object of dispute, the switch is made to the presentation of evidence. The documents of the late 15th – middle 16th c. confirm that the hat would be placed in the presence of witnesses. However, already in the early 16th c. witnesses were being replaced by documents, i.e., written evidence, which was favoured by the First Statute of Lithuania. Although the customary norm of hat-placing was not drafted into the Statute, it was practised in different law courts of the GDL in the early 16th c. This shows that it was acknowledged by judges as being legitimate. In historiography, the hat-placing custom is associated with the custom of pledge (vadium). This, however, provokes much discussion, since those placing a hat increasingly seldom mention a pledge. Even so, the court materials from rulers and commissioners of the early 16th c. confirm that a pledge “in the hat” had really existed. Its magnitude and worth, measured not only by money, varied and depended on the litigator’s economic and social status. Although one can observe the diminishing numbers of those placing a hat with pledges, the attachment of the GDL noblemen of the early 17th c. to the law, propped by conservative customs and traditions, and their unwillingness to renounce the oral legal culture created by ancestors is evident.
