LTStraipsnyje nagrinėjamos darbdavių organizacijų teisinio statuso problemos, kurių kyla pagal Lietuvos Respublikos įstatymus. Problemų esmė yra ta, kad Lietuvos įstatymuose nėra specialiųjų normų apie darbdavių organizacijas. Darbdavių organizacijos Lietuvos Respublikoje gali jungtis pagal bendrosios paskirties visuomeninių organizacijų arba asociacijų įstatymus. Dėl to jos savaime neįgauna savo narių atstovavimo darbo santykiuose teisių, o ypač atstovavimo kolektyvinėse derybose ir sudarant kolektyvines sutartis kompetencijos. ENAuthor of the article presents the analysis of the laws in the Republic of Lithuania and specifies the existing problems of the legal status of employers' organizations, especially in area of representation of employers in collective bargaining and concluding collective agreements. The Republic of Lithuania in contrast to some other countries, has no special law covering the employers' organizations. Moreover, Lithuanian laws in great details regulating trade unions activities however contain no special norms, which secure the legal status of employers' organizations. Employers' organizations in the Republic of Lithuania may simply associate in accordance with the laws on public organizations or associations for general purposes. Whereas employers' organizations under Lithuanian laws act as associations of a general competence, they naturally fail to obtain ipso facto the rights to represent their members in collective bargaining and signing of agreements that are binding on the employer - member of the association. The right of organization to represent a member in collective bargaining and to conclude collective agreements at higher level than enterprise (i.e. sector of economy, regional, national levels) should be specified in the constitution (by-laws) of the employers' organization. Analysis of the constitutions of large employers' organizations operating presently in Lithuania allows to maintain that they are not specialized associations adapted for labour relations, but universal multifunctional institutions, the main targets of which are mostly economic and political. Practically they are not adapted for signing collective agreements, because their regulations do not stipulate any powers of employers' representation in collective bargaining and concluding collective agreements.
